勘報災歉條例

When local areas have water, drought, wind, hail, insect pest, or other disasters, the survey-reporting matters must be handled under this law.

Certain county/city officials and joint inspection personnel must be disciplined if they fail to inspect, report inaccurately, delay inspection, or otherwise meet the listed disaster-reporting deadlines.

當院轄市或相當於省、縣之行政區域轄內發生災歉時，依本條例規定辦理。

各省省政府要依各省情形擬訂本條例施行規則，並呈請行政院核定。

This provision says the regulation takes effect on the date it is promulgated.

受災地方應先由當地鄉鎮公所報告災情，之後由縣、市政府會同田糧管理機關派員實地初勘；查證屬實後，立即報省政府，並另製災歉狀況表呈核。

省政府在收到前條報告後，應督促相關機關派員實地覆勘；查明屬實後，依覆勘報告核定災害程度，按第八條減免田賦，並把減免後的徵糧數額估算後報請糧食部核定。

This provision sets reporting deadlines for disasters: summer disasters by August 15 and autumn disasters by November 15. It also allows later-climate areas to get a discretionary extension, and sudden emergency-caused disasters are excluded from the deadline.

縣（市）政府、田糧管理機關和省派員對災害勘查都有期限要求：旱、蟲災要據報後隨時履勘並在5日內勘畢；風、水、雹災及其他急災要立時履勘並在3日內勘畢；省派員覆勘則要在接報後5日內出發，並在到達災地後5日內勘畢。

For follow-up disaster reports, drought and insect disasters still follow the original deadline; other follow-up disasters must be merged into the original report before re-inspection, unless the first disaster reporting deadline has already passed.

If summer disaster damage is mild and autumn crops can still be sown, the damage assessment is deferred until the autumn harvest; if autumn crops are not sown, the assessment is made during the summer disaster.

各省應依被災農地的收穫總量核定減免成數；收穫越少，田賦減免越多，收穫達八成以上則不予減免。

省政府在有需要賑濟的災區，應核實災情和災民人數，撥款賑濟，並分別通知財政部、糧食部備案；災情重大或災區較廣時，得報請中央補助。
