臺灣地區公共建設土地債券發行條例

This provision authorizes the relevant provincial/municipal government to issue public construction land bonds.

本債券可以轉讓、買賣，並可作為司法、稅務及其他公務上的保證。

本債券的當年息票或本息票，可以全額抵繳發行省市的工程受益費。

This bond is exempt from stamp tax and income tax.

If the bond is not claimed within five years after the end of the fiscal year in which the last principal or interest payment became payable, it will no longer be redeemed.

This provision says the bonds are to be used only for compensating land value and building improvements when acquiring land for specified public construction projects.

Each province or city’s annual bond issuance may not exceed 20% of that year’s local total budget, and annual principal-plus-interest payments may not exceed 25%.

發行該債券的省市政府要擬具發行計畫，並報請行政院核定。

省（市）政府先擬訂本債券的搭發成數，經省（市）議會通過後，再報請行政院核定。

Issuing provincial or municipal governments may委託 Taiwan Land Bank or a municipal bank to handle bond issuance and repayment/interest matters.

發行債券的省（市）政府要每年編列還本付息基金預算，並預先撥入指定銀行專戶；臺灣省轄縣（市）政府在特定補償情形下，得由省撥借土地債券分年歸還。

The bond’s repayment term is 4 to 8 years. Interest is paid once a year in the first two years, and from the third year onward the principal and interest are repaid annually until fully paid off at maturity.

This provision says the bond is issued as a bearer instrument, is paid on presentation of the certificate, and cannot be reported lost.
