教育基本法

This provision states that the law is enacted to protect people’s right to learn and receive education, set basic education policy, and strengthen the education system.

直轄市及縣（市）政府應設立教育審議委員會，並由委員會定期開會辦理教育事務的審議、諮詢、協調及評鑑；其設置辦法由地方政府自行訂定。

國民基本教育的年限應依社會發展需要延長；學校編制原則上應採小班小校，中央主管教育行政機關並應每年會同地方政府推估未來五年學生與教師人數，據以規劃班級學生人數與教師員額，並提供各校必要協助。

國家應建立現代化教育制度，並推動學校、家庭與社會教育的普及、協調發展及終身教育。

政府及民間可按需要進行教育實驗，並應加強教育研究及評鑑工作。

People have the right to request academic ability assessment.

When these rights are infringed by a school or education authority, the government must provide the person affected or their legal representative with effective and fair channels for relief.

This provision says that after the law takes effect, related education laws and regulations must be amended, repealed, or enacted according to this law.

This provision says the law takes effect on the date it is promulgated, except for the provisions amended on 14 June 2011, whose effective date is set by the Executive Yuan.

People are the holders of the right to education, and the state, educational institutions, teachers, and parents must help achieve the education purpose.

Education should be implemented on the principles of equal access, teaching to individual differences, and respect for human dignity and scientific methods.

人民享有接受教育機會平等；原住民、身心障礙者及其他弱勢族群的教育應依法令獲得特別保障並受扶助發展。

各級政府應增加教育經費、確保專款專用，並合理分配與運用教育資源；對偏遠及特殊地區的教育應優先補助。

Schools may not promote or conduct activities for specific political groups, public schools may not promote or conduct activities for specific religious beliefs, and private schools may hold certain religious activities only within their school purpose and without discriminating against people who do not participate.

人民有依教育目的興學的自由；政府應依法提供協助、補助並監督民間教育事業，且可在鼓勵私人興學時委託私人辦理公立學校。

This provision says students’ rights must be protected, teachers’ professional autonomy should be respected, parents have a duty to guide their children and may choose their children’s education options in the national education stage, schools must provide a good learning environment, and the central education authority sets bullying-prevention rules.

This provision assigns listed education powers to the central government and leaves other education matters to local government unless another law says otherwise.
