幼稚教育法

This provision states that preschool education is intended to promote children’s healthy physical and mental development.

不同類型幼稚園的園長，由相應的政府、機構、校長或董事會遴選並聘任，部分情形還要報請教育主管機關備查或核備。

This provision assigns who appoints kindergarten teachers depending on the kind of kindergarten.

幼稚園教師 must meet one of the listed qualification conditions, and 幼稚園園長 must have teacher qualification.

公立幼稚園人員的待遇、退休、撫卹、保險、福利與成績考核，分別比照公立國民小學相關規定辦理；私立幼稚園則須依有關法令訂章、籌措專款，並向所在地主管教育行政機關備查。

Private kindergartens with outstanding performance may be rewarded by the competent education authority, and the Ministry of Education is to prescribe the implementing rules.

私人或團體捐贈公立幼稚園或已辦妥財團法人登記的私立幼稚園，得依相關稅法規定免稅。

公立幼稚園或已辦妥財團法人登記的私立幼稚園，在取得所在地主管教育行政機關證明後，可依關稅法申請教學用圖書及用品免稅進口。

公私立幼稚園的收費項目、用途及數額，須經所在地主管教育行政機關核定。

幼稚園要辦理兒童團體保險；兒童申請理賠時，幼稚園要主動協助。主管教育行政機關還要替轄區內公私立幼稚園場所投保公共意外責任保險，相關經費由教育部按年度預算支應。

幼稚園兒童上下學應有導護以確保交通安全；若由幼稚園安排車輛接送，車輛須經交通監理單位檢定合格，並且要嚴格限制乘車人數、派員隨車照護。

If a private kindergarten is poorly managed or violates the law, the local competent education authority must impose a sanction based on the circumstances.

This provision defines “幼稚教育” as education received in kindergarten by children from age four until before entering elementary school.

If a private kindergarten has the circumstances referred to in the previous article, and the situation is serious or it still does not improve after being penalized under the previous article, its registration may be revoked and it may be ordered to suspend operations or be dissolved according to law.

私立幼稚園停辦時，若是被勒令停辦，主管教育行政機關要派員監督清理結束事務；若是幼稚園自行申請停辦，董事會或負責人要先說明理由並報請核准後才能辦理。

幼稚園負責人、園長、教師或職員如有列舉情形，主管教育行政機關可視情節予以申誡或記過；情節重大時可解除職務，涉及刑法的則移送法院。

未經核准立案的私立幼稚園，或已被停止招生、停辦、解散處分後仍招生者，會被主管教育行政機關報請當地政府取締；其負責人可處一萬至五萬元罰鍰。

This provision assigns who handles fines under Article 21(2) and the preceding article: in a special municipality, the competent education administrative authority reports to the city government; in a county or city, the county/city government imposes the fine and sets a payment deadline.

逾期未繳依第二十一條及第二十二條處的罰鍰，會移送法院強制執行。

The listed provisions of the Private School Act apply to private kindergartens.

Certain people may not serve as a kindergarten director or responsible person if they have any of the listed disqualifying conditions.

幼稚園每班兒童不得超過30人；班級人數在15人以下時，只需1名導師，其餘教師配置與導師費發給方式由主管機關另定。

幼稚園應置園長一人，園長須專任，並可兼任本園教學。
