直轄市、縣（市）主管機關應協助離島、偏遠地區的國民小學附設幼兒園；特定地區、原住民族相關機構，以及政府機關（構）、公司和非政府組織，得在許可設立後採互助式方式提供幼兒教保服務。

教保服務的實施應與家庭及社區密切配合，並以增進幼兒各項發展與認同為目標。

This provision lists preschool care services, allows parents or guardians to choose certain attendance patterns, lets institutions provide extended or temporary care in defined cases, and gives the central authority power to set curriculum and service rules.

提供延長照顧服務的人員，必須符合列出的資格之一；在離島、偏遠或原住民族地區，相關機關可核准減少部分人員的專業訓練時數。

公立托兒所改制為公立幼兒園後，原有相關人員與工友仍依原適用法令辦理其人事事項。

公立幼兒園及私立教保服務機構的其他服務人員，依勞動基準法等規定處理勞動條件；公立者以契約進用，契約須明定權利義務，相關進用、考核與待遇辦法由中央主管機關訂定。

教保服務機構在其他服務人員符合列舉的不當或違法情形時，應予解聘等處分，並終身不得再聘任、任用、進用或運用。

教保服務機構遇到符合列舉情形的其他服務人員時，應予解聘或終止關係，並認定其一年至四年不得再被聘任、任用、進用或運用。

教保服務機構不得聘用符合列舉情形的其他服務人員；已在職者，應予解聘或終止相關關係。

教保服務機構負責人或其他服務人員在執行業務時，若知悉特定違規行為，原則上應通報直轄市、縣（市）主管機關。

教保服務機構與地方主管機關在特定人員有指定情形時，應辦理通報及相關資訊的蒐集、查詢、處理與利用；教保服務機構在聘用其他服務人員前及任用後，還要定期查詢。

This provision sets retirement, suspension, and salary-repayment rules for certain childcare institution staff.

Certain childcare facility leaders and directors are disqualified if they fall within specified categories, and local authorities must revoke or require replacement in some cases.

教保服務機構 must 建立幼兒健康管理制度，配合衛生主管機關辦理健康檢查，並管理、保存幼兒健康資料；父母或監護人 also must 依期限提供預防接種資料。

教保服務機構、幼兒園及其護理人員要建立急救與健康照護措施，並定期接受救護訓練。

教保服務機構要依相關規定辦理幼兒團體保險，幼兒申請理賠時要主動協助；各級主管機關要為轄內教保服務機構投保場所公共意外責任保險，費用由中央主管機關按年度預算支應。

幼兒園可以成立家長會；附設在國民中、小學的，改併入該校家長會辦理。

父母、監護人及家長團體可以請求直轄市、縣（市）主管機關提供指定的教保服務資訊，主管機關不得拒絕。

教保服務機構必須公開其教保目標、師資與人員資料、衛生安全與緊急處理措施、組織與員額、幼兒團體保險、收退費與減免規定，以及招收人數資訊。

Parents or guardians who disagree with a childcare institution’s service method or content may ask for an explanation, and the institution may not refuse without a justified reason.

直轄市、縣（市）層級的家長團體和教保服務人員組織，可以參與主管機關對幼兒園評鑑的規劃。

各級主管機關應召開諮詢會，並由各主管機關訂定其組織、會議及相關事項的辦法與自治法規。

Parents or guardians may object to a childcare service that harms a child’s rights, and may appeal to the local competent authority within 30 days after learning the result; they may also file an administrative appeal or lawsuit if they disagree with the authority’s decision.

父母或監護人必須依契約繳費，參加教保服務機構安排的相關活動，並在必要時告知並提供幼兒特殊健康狀況資料，且與機構協力改善幼兒身心健康。

If the listed violations occur, the responsible person or actor can be fined NT$60,000 to NT$300,000 and ordered to stop operations; if they refuse, repeated fines may be imposed. The local competent authority must also publish the site address and the person’s name.

幼兒園如果發生本條列舉的違規情形，負責人可被處新臺幣6萬元以上30萬元以下罰鍰，並命限期改善；未改善者還可能被按次處罰，情節重大時可再被減少招收人數、停止招生、停辦或廢止設立許可。

If an early childhood education and care institution, its responsible person, or other staff violates Article 32(5), the responsible person or staff may be fined NT$30,000 to NT$150,000, and the fine may be imposed repeatedly.

直轄市、縣（市）主管機關負責地方性教保服務的規劃、推動、監督、評鑑、資料蒐集公布及其他相關事項。

駕駛人、隨車人員或護理人員未依規定完成訓練時，先要限期改善；屆期仍未改善的，會被罰新臺幣1,000元至6,000元，並可按次處罰。若可歸責於幼兒園，則改對幼兒園要求改善並對負責人罰鍰，情節重大或屢罰不改時還可進一步限制招生或廢止設立許可。

地方主管機關負責本法所定的限期改善與處罰；受罰的教保服務機構名稱和負責人姓名應公布，法人型機構被廢止設立許可時還要通知法院解散。

部分托兒所改制成幼兒園後，需在指定期限前符合每班至少有一名幼兒園教師的配置規定；另由中央主管機關按財力補助地方設置公立或非營利幼兒園。

Certain existing childcare/kindergarten facilities may apply for kindergarten establishment permission during 2012–2013 under the equipment rules in force when they were originally approved; everyone else must follow the Article 8(6) equipment rules.

各級主管機關得為瞭解與規劃相關教保服務、補助、員額配置或人員進用，蒐集、處理或利用學前教育階段幼兒及人員的個人資料，並建立相關資料庫。
