各級學校扶助學生就學勸募條例

This article says school fundraising or acceptance of cash donations to help economically disadvantaged students continue schooling is governed by this act; other fundraising follows the Charity Solicitation Act.

學校收到勸募款項時，必須開立收據，並載明許可文號、捐款人姓名、金額與日期；如有指定對象或特定用途，也要一併載明。

學校每月要在教育部指定網站公告教育儲蓄戶收支明細；每年1月31日前還要將前一年度收支報告與結餘留用情形報主管機關備查，並在指定網站公告。

學校進行勸募時，不得用強制攤派、違反當事人意願、向有服從或受監督關係的人強行勸募，也不得接受有直接利害關係者的捐贈。

學校主管機關可以檢查學校收受的捐款、教育儲蓄戶辦理情形及相關帳冊；學校及其人員不得規避、妨礙或拒絕檢查。

學校在特定情況下要先向學校主管機關報告，主管機關可廢止勸募許可；之後剩餘款要清算、必要時再報請指定其他學校教育儲蓄戶執行，最後結束該戶。

If a school falls within any of the listed cases, the school authority may fine it NT$50,000 to NT$250,000, order correction within a deadline, repeat the penalty if it still does not comply, and revoke the fundraising permit in serious cases.

This provision identifies the competent authority for this regulation at three levels: the central authority is the Ministry of Education, the municipal authority is the municipal government, and the county/city authority is the county/city government.

符合條件的學校在本條例施行後，須依原計畫繼續辦理原先的勸募活動與財務使用，直到期限屆滿；如教育儲蓄戶有賸餘款，學校在依本條例申請並取得許可勸募後，得繼續運用。

國防部設立的軍事學校若為扶助經濟弱勢自費學生就學而勸募金錢或接受金錢捐贈，適用第三條至第十四條；違反者由國防部依第十五條至第十八條處罰。

學校在完成設戶與報備後，可以向社會大眾公開勸募，並且必須設置教育儲蓄戶管理小組來管理收支、保管與運用。

學校要依捐款人指定的對象或用途使用捐款；若指定對象畢業後仍有餘款，學校需先報請學校主管機關核准，再用於扶助其他學生，但捐款人另有指定時可移轉繼續執行。
