學生輔導法

This Act is enacted to promote and protect student physical and mental health and whole-person development, and to improve student counseling work. Student counseling is governed by this Act, unless the Special Education Act or laws relating to juvenile correction schools provide otherwise.

高級中等以下學校必須依學制和班級數配置專任輔導教師員額。

各高級中等以下學校主管機關及專科以上學校，必須依學生與學校數量配置專任專業輔導人員；中央主管機關還可在一定範圍內加配人力並補助經費。

高級中等以下學校主管機關必須依轄內專業輔導人員人數，指定督導人員：每滿7人至少選1人；未滿7人時也要選1人。

This provision assigns counseling duties to teachers, counseling teachers, and professional counselors in different school levels, and gives the central authority power to set related rules.

高級中等以下學校要依課程綱要安排輔導相關課程或班級輔導活動，並由相關專任教師或輔導教師授課；專任輔導教師不得排課。

主管機關、學校及聘用機關或學校都要安排輔導知能訓練／進修，並給參訓人員公（差）假；部分訓練有最低時數要求。

Counseling teachers and professional counselors must have in-service training participation and student counseling performance included in their performance appraisal, and those with good results should be rewarded.

Schools must provide the space and equipment needed for student counseling and carry out and promote that work. The central competent authority sets the setup standards.

學生輔導工作相關人員對於因業務知悉或持有的他人秘密，原則上要保密不得洩漏；法律另有規定或為避免緊急危難時，不在此限。

學校要定期做學生輔導工作的自我評鑑；各級主管機關也要定期評鑑學校執行學生輔導工作的成效。

學校應提供整體性、持續性的轉銜輔導及服務；中央主管機關可訂定相關辦法，並可建置學生通報系統供學校使用。

This provision identifies which government body is the competent authority for different schools and requires the relevant agencies to cooperate when a matter overlaps their business.

各級主管機關及學校為推動學生輔導工作，應優先編列所需經費，並專款專用。

高級中等學校以下學生的家長、監護人或法定代理人，應配合學校參與輔導相關活動並提供必要協助；各級學校則應主動通知輔導資源或輔導活動資訊。

第十條及第十一條中關於專任輔導教師與專任專業輔導人員的配置規定，從一百零六年八月一日起逐年增加，並由中央主管機關自一百零六年起每五年檢討一次。

本法的施行細則由中央主管機關訂定。

This law takes effect on the date of promulgation; the effective date for the amended provisions in Articles 1-3, 11, and 11-1 is set by the Executive Yuan.

This provision defines “school,” “counseling teacher,” and “professional counseling personnel,” gives the central competent authority power to set counseling teacher qualifications, and allows juvenile correction schools to not apply certain parent-representative rules.

主管機關必須指定學生輔導專責單位或人員；高級中等以下學校主管機關應設學生輔導諮商中心，並配置人力、制定相關辦法、編列預算。

各級主管機關應召開學生輔導諮詢會，並由機關首長擔任召集人、聘兼委員；委員組成與運作規則由主管機關訂定。

具心理師證書的專業輔導人員，經學生同意且學校開會評估有需求時，得在未經法定代理人同意下為未成年學生執行輔導諮商。

學校要依學生身心狀況與需求，提供三級輔導：發展性、介入性或處遇性輔導。

學校必須追蹤接受介入性或處遇性輔導的學生；學校也可以召開個案會議、訂定輔導方案，並在需要時彈性處理出缺勤紀錄或成績考核。

學校校長、教師、專業輔導人員及相關單位都有學生輔導責任；學校在需要時可結合外部資源請求協助，受請求機關（構）應配合。

高級中等以下學校應設學生輔導工作委員會，並由校長兼任主任委員；校長還要聘任其他委員。

學校要由專責單位或專責人員推動學生輔導工作，並妥善保存學生輔導資料；相關保存與個資處理細節由中央主管機關訂定。
