特殊教育法

This provision states the law is enacted to ensure persons with disabilities and gifted citizens have the right to appropriate and inclusive education.

特殊教育學生及幼兒的權益應受尊重與保障；中央主管機關要研擬合理調整與申請程序指引，並邀請身心障礙者及其代表組織參與。

身心障礙學生有權就所有影響自己的事項自由表達意見，並可獲得符合其身心障礙狀況與年齡的協助措施。

特殊教育分四個教育階段辦理；在學前與國民教育階段，主管機關應提供入學資訊與人力、資源協助，並可在必要時安置學生到其他適當場所。

Schools and kindergartens below senior high school level must actively implement inclusive education and may set special education classes, subject to approval and standards set by the competent authorities.

特殊教育學生的入學年齡、年級安排、教育場所、實施方式和修業年限應保有彈性；相關提前或延後入學、縮短或延長修業年限等辦法，由中央主管機關訂定。

Certain schools must set up a special education committee, and the committee must include specified student and parent representatives.

各級主管機關原則上辦理各教育階段的特殊教育，也可以補助民間辦理；對民間辦理身心障礙教育者，應優先補助。

Schools at or below senior secondary level must set up a dedicated special education unit and hire needed special education staff; kindergartens with three or more special education classes are treated the same.

主管機關應加強特殊教育與融合教育相關人員的培訓、在職進修，並設置諮詢管道。

各級主管機關為實施特殊教育，應依鑑定基準辦理特殊教育學生及幼兒的鑑定；相關基準、程序、期程、評估與培訓等辦法由中央主管機關訂定。

This provision says which authority counts as the competent authority and requires relevant agencies to cooperate when matters under this law involve another competent authority’s business.

Schools must identify students and young children who may need special education, place them with consent and consultation, provide special education services, and the competent authority must review the placement and services each year.

中央主管機關必須訂定高級中等以下學校特殊教育課程綱要及其實施規定，學校規劃課程時可以結合社會資源。

特殊教育課程、教材、教法和評量要保持彈性，並符合特殊教育學生與幼兒的身心特性及需求。

各級學校在特殊教育教學時應結合相關資源，並可以聘任具特殊專才者協助教學。

This provision lets specified special education students, their legal representatives, or caregivers file complaints and further appeals about placement, support services, or school discipline decisions, and requires the competent authority to provide complaint services.

學校、幼兒園和試務單位不得因身心障礙拒絕學生或幼兒入學、入園或應試；並應提供考試服務、無障礙措施與合理調整。

各級主管機關應依專業評估結果，結合相關部門資源，提供身心障礙學生及幼兒復健、訓練等支持服務；中央主管機關並負責訂定相關辦法。

主管機關、學校與幼兒園要提供並配合身心障礙學生及幼兒的支持服務；高級中等以下學校與幼兒園原則上應以專業團隊合作辦理，中央主管機關並負責訂定相關辦法。

本條規定特殊教育學校的設立、類型、核定程序、主管機關授權事項，以及學校與社區合作和經費補助要求。

特殊教育學校要設校長，並可依需要設一級、二級單位；部分職務由校長從專任教師中聘兼，啟聰學校的校長和教師應優先遴聘具手語知能者。

This provision defines “身心障礙” as a condition involving listed physical or psychological impairments, confirmed by professional assessment, that creates special learning needs and requires special education and related support.

高級中等以下學校和幼兒園要加強教師合作，並對就讀普通班的身心障礙學生或幼兒提供適當教學及輔導。

學校要以團隊合作方式為身心障礙學生訂定個別化教育計畫，並在規定期限內完成、定期檢討；主管機關也要訂定參考指引。

各級主管機關應依所屬學校及幼兒園身心障礙學生、幼兒的特殊教育需求，加強辦理教師、教保服務人員、特殊教育教師及相關人員的培訓與在職進修，並協助提供支持服務。

Schools at the senior-high level and below must consider disabled students’ strengths, aptitude, special education needs, and career plans, and provide suitable guidance for further study.

各級主管機關 must actively promote lifelong learning for adults with disabilities, make work plans, encourage participation, and regularly check results. The central competent authority may set rules on the implementing agencies, methods, content, and related matters.

大專校院要為身心障礙學生訂定並實施特殊教育方案，設置專責單位、資源教室與人員，並為學生訂定與定期檢討個別化支持計畫。

各級學校及幼兒園應提供持續、整體的轉銜輔導及服務；中央主管機關並負責訂定生涯轉銜相關辦法。

主管機關應依身心障礙學生家庭經濟條件減免就學費用；對就讀私立學前幼兒園或社福機構的身心障礙幼兒，得發給教育補助費並獎助招收單位。

學校、幼兒園及主管機關必須為身心障礙學生和幼兒提供教育支持服務；符合條件者還可取得免費無障礙交通工具或交通費補助。

各級主管機關可以依申請核准或委託社會福利機構、醫療機構辦理身心障礙教育，並且應協助少年矯正學校辦理這項教育。

This provision defines “資賦優異” and lists the types covered.

資賦優異教育在不同教育階段，依各階段指定方式辦理。

高級中等以上教育階段學校可以參考資賦優異學生的在學表現和潛在優勢能力，採多元入學方式辦理。

高級中等以下學校 must 以團隊合作方式，為資賦優異學生訂定個別輔導計畫，並邀請學生本人、法定代理人或實際照顧者參與。

主管機關應補助學校辦理多元資優教育方案；對有特殊表現的資賦優異學生，主管機關也應給予獎助。

資賦優異學生可以提前修讀較高一級以上教育階段的課程；該課程及格者，入學後可以抵免。

各級主管機關要編列預算並推動高級中等以下學校的資賦優異教育；中央主管機關要補助地方主管機關經費。

主管機關及學校應加強特定資賦優異學生的鑑定與輔導，並可視需要調整評量項目、工具及程序。

Gifted education at the senior high education stage should take students’ aptitudes and strengths into account and may be delivered through a special education program.

中央主管機關可以委請專業團體或學術機構進行融合教育、特殊教育研究；各級主管機關應鼓勵教師研究，並公開、推廣研究成果。

中央及直轄市主管機關應鼓勵相關師資培育學校在職前教育階段開設特殊教育課程；中央主管機關並應把這類課程納入師資職前教育課程基準。

各級主管機關應設立特殊教育諮詢會，並讓其至少每六個月開會一次、公開委員名單及會議紀錄；主管機關也負責訂定相關辦法。

中央主管機關應編列經費補助設有特殊教育系、所的大學校院設置特殊教育中心；設有特殊教育系的大學校院得附設特殊教育學校（班）。

各級主管機關應建立特殊教育行政支持網絡，並可借調公立學校或幼兒園教師組成特殊教育資源中心及輔導團；中央主管機關與各級主管機關並分別就相關辦法定之。

Schools and kindergartens must provide support services for special education students and young children’s families, and the competent authorities must fund and implement those services. Parents of disabled students in senior high school level and below must have at least one person serve on the school parents’ association committee and help promote special education matters.

主管機關與中央主管機關須定期辦理特殊教育評鑑，部分評鑑可併同其他評鑑辦理。

公立特殊教育學校相關收入及支出，應設專帳以代收代付方式辦理；賸餘款得保留作改善學校基本設施或充實教學設備，並不受部分預算及公產管理規定限制。

主管機關在訂定本法授權的法規或自治法規時，應邀請教師、教保服務人員、家長團體及特殊教育學生參與。

中央主管機關負責訂定本法施行細則。

This Act takes effect on the date of publication.

各級主管機關必須設置特殊教育學生鑑定及就學輔導會，並訂定相關辦法；鑑輔會名單要公告，且至少每六個月開會一次。

主管機關為執行特殊教育工作，應設專責單位；學校、幼兒園及特殊教育學校的相關人員，應進用具特殊教育相關專業者。

各級主管機關每年應定期辦理特殊教育學生與幼兒狀況調查、教育安置需求通報，並公布概況、出版年報與數據分析，且依實際現況與需求分配資源、規劃措施。

各級政府應寬列特殊教育預算；中央與地方都有最低編列比例，地方政府編列預算時並應優先辦理身心障礙教育。
