教育部所屬機構作業基金設置條例

教育部為因應機構發展需要，設置教育部所屬機構作業基金，並以本條例作為依據。

If the fund has a surplus in its annual final accounts, it must distribute it according to the rules.

本基金辦理年度預算編製、執行及決算編造時，應依預算法、會計法、決算法、審計法及相關法令辦理。

基金結束時，應先結算，剩餘的權益要解繳國庫。

本條規定本基金及其下設作業基金的預算編製方式，並設定作業基金設置的自籌財源門檻；同時指定主管機關與管理機關。

本基金受贈財產通常由各該機構管理、教育部為主管機關；受贈及投資取得的動產、有價證券和權利，經教育部同意後可處分；前項有價證券出售要依證券交易相關法令辦理。

教育部統一訂定本基金會計制度，供依本條例設置作業基金的機構依此辦理。
