學校教職員退休條例

學校教職員的退休，依本條例辦理。

請領退休金的權利，自退休次月起算，5年不行使就消滅；若因不可抗力不能行使，則改自可行使時起算。

Certain seconded teachers on leave without pay may retire within five years after turning 65 if specified conditions are met; their former school may also apply to repay retirement and pension fund contributions within that same five-year period.

月退休金從退休後的次月開始發給。

退休教職員在列明情形之一時，會喪失領受退休金的權利。

退休教職員在兩種情況下會停止領取退休金：尚未復權的褫奪公權，或領月退休金後又再任有給公職；原因消滅後恢復。

Certain retired, severed, or resigned personnel who take school employment again do not have to repay benefits already received, but their earlier service years are not counted again when they retire later.

月退休金或兼領月退休金的人死亡時，遺族可領一次撫慰金；特定遺族也可選擇改領月撫慰金。

請領退休金的權利，不得被扣押、讓與或作為擔保。

退休教職員及其特定家屬回籍時，最後服務學校可按路程遠近給予旅費。

學校主計及人事人員的退休，應依公務人員退休法辦理。

This article says retirement for several listed education-related workers follows this statute, except for people who are civil servants, who still follow the civil servant retirement rules.

This provision defines “school staff” as current full-time teaching staff at public schools of any level who were appointed under the required qualifications and have been reported on file with the competent education administrative authority.
