學校教職員撫卹條例

School teachers and staff’s survivor benefits are handled under this statute.

遺族年撫卹金自教職員死亡的次月起發給，依死亡原因不同，發給10年、15年或20年；符合特定家屬條件者可終身領取，且在子女未成年或就學不中斷時可延長給卹。

遺族如符合列舉情形之一，會喪失撫卹金領受權。

教職員遺族若已被褫奪公權且尚未復權，暫停領受撫卹金；原因消滅後恢復。

請卹及各期撫卹金的請領權，從請卹或請領事由發生後的次月起算，五年內不行使就消滅；遇不可抗力而不能行使時，適用中斷後重新起算的規則。

教職員在停聘、休職、因案停職或依規定留職停薪期間，符合特定條件時，得依本條例辦理撫卹；教師借調留職停薪未回職復薪，且在屆滿65歲後5年內死亡者，也適用。

領受撫卹金的權利，以及尚未由遺族領取的撫卹金，不得被扣押、讓與或作為擔保。

教職員在職亡故時，應發給殮葬補助費；其標準由教育部報請行政院核定。

教職員年資要合併計算，撫卹金依修正後規定辦理；相關費用依不同學校類型，由基金、各級政府預算或各庫支給。

曾在其他職位領過退休金的教職員，在計算撫卹金年資時，應扣除已領退休金所對應的年資。

Certain nursing teachers assigned to public or private schools are covered by the pension rules in the referenced statute, and pension for service years before October 30, 2001 is paid from the public treasury.

本條把可依本條例撫卹的教職員，限定為各級公立學校的現職專任教職員，且需依規定資格任用並已報請主管教育行政機關有案。

外國人在中華民國公立中等以上學校任教師，若在職死亡，其撫卹事項準用本條例；但只能給與一次撫卹金。

本條例的施行細則由教育部訂定。

本條例自公布日施行；修正條文的施行日期由行政院會同考試院以命令定之。

If a teaching staff member dies from illness, accident, or in the line of duty, their survivors are entitled to a bereavement payment.

教職員死亡時，如其本人實物代金、眷屬實物代金及眷屬補助費符合本條件，相關給付依規定加發。

Defines who counts as a public-duty death case and adds an extra one-time pension payment.

If a teacher or staff member dies after 20 years of service, the death benefits may be paid under the one-time retirement pension standard instead, when the deceased left a will or when the heirs do not want the benefits under the cited rules.

教職員如果受有勳章或有特殊功績，可以增加一次撫卹金額；增加標準由教育部報請行政院核定。

教職員死亡後，撫卹金依法定順序由遺族領受；同順位多人時平均分領，且可依遺囑指定領受人。
