私立學校教職員保險條例

This provision states the law’s purpose for private school teachers and staff and says any matters not covered here follow the Civil Servants Insurance Act and related rules.

School teachers’ and staff insurance premiums must be paid monthly, with 35% paid by the insured person, 32.5% borne by the school, and 32.5% subsidized by the government.

各要保學校須按月扣繳並在每月15日前把相關保險費一併彙繳給承保機關；逾期未繳的，可能有30日寬限，之後還會被依法追繳並暫停給付。

未參加勞工保險的私立學校，應一律參加本保險。

本條例的施行細則由教育部和銓敘部會同訂定。

本條例的施行日期，須由行政院與考試院會同以命令決定。

This provision defines “private school” as a school that has completed foundation registration under the Private School Act and has been approved for establishment by the competent education authority.

私立學校的編制內有給、專任教職員要參加本保險，需符合列出的資格；對於本條例公布後到職者，申請參加年齡不得超過65歲。

私立學校為教學及實習需要附設的工廠、醫院、農場、銀行、商店等，其職員如果不是學校編制內人員，不適用本條例。

銓敘部是本保險的主管機關；私立學校要申請成為本保險的要保學校，必須先經主管教育行政機關核准，並函報銓敘部備查。

本保險由中央信託局辦理；如有虧損，由財政部審核後撥補。

經核准要保的學校，應在核准後一個月內替所屬教職員辦理要保；私立學校經核准為要保學校者，其符合第三條的教職員一律參加本保險。

This provision says insurance service years start from the day insurance coverage begins, other insurance service years are not counted, and a person who re-joins this insurance after receiving an old-age benefit must repay that benefit in full; later retirement benefits then count the years together.

私立學校教職員保險的保險費率，按被保險人每月保險薪給的百分之四點五至百分之九計算。
