教師待遇條例

教師的待遇依本條例辦理。

中小學教師在職進修、研究且取得較高學歷時，可依規定改敘薪級，並受所聘職務等級最高本薪限制。

教師轉任不同類型學校時，薪級依本條規則重定；公立學校教師轉任其他公立學校教師時原則上按原敘薪級核敘，但遇到原薪級高於新職最高年功薪時，改按最高年功薪核敘，超過部分保留。

For private schools and public colleges, teacher salary-grade advancement is handled by the school under the stated rules; public college teachers are assessed annually and may advance one grade, subject to the top merit-salary limit.

This provision provides three types of salary supplements: duty, academic research, and regional supplements.

公立學校部分教師與特定工作者的職務加給條件和金額，由教育部按學校層級、組織層級及職責程度擬訂，並報行政院核定。

公立學校教師的獎金，政府得視財政狀況發給；相關辦法由教育部會商後擬訂並報行政院核定。私立學校教師的獎金，除政府依規定發給外，由各校依教師教學工作與財務狀況自行辦理，並由各校決定發給對象、類別、條件、程序及金額。

教師在停聘、失蹤、回復聘任或曠職／請事假超過規定日數時，薪給的發放或扣除有特定處理方式。

Teachers’ compensation is divided into base pay (including seniority pay), allowances, and bonuses.

政府可以視財政狀況規劃公立學校教師福利措施；私立學校也可以視財務狀況自行辦理教師福利措施及津貼。

這些人員原則上準用公立學校教師的規定，但如其他法律另有規定，則依其他法律。

軍警學校與矯正學校的部分教師、助教薪給與待遇，原則上依本條例或公立學校教師規定辦理；另在準用本條例時，所屬主管機關就是本條例所稱主管機關。

私立學校在列舉情形下，經主管機關限期改善後仍未改善的，主管機關得處新臺幣10萬元以上50萬元以下罰鍰，並可按次處罰直到改善為止。

If a private school does not pay a teacher’s salary under the employment contract, all directors of the school’s foundation are jointly liable with the school for the unpaid amount.
