科學技術基本法

This provision states the law’s purpose: to set basic policies and principles for promoting science and technology development.

The government must consider national development, social needs, and balanced regional development, and every four years set a national science and technology development plan. The plan is to be based on consultations and discussion by the National Science and Technology Conference, and approved by the Executive Yuan.

國家科學技術發展計畫應包含列明的事項。

行政院應設置國家科學技術發展基金並編製附屬單位預算；基金運用應配合國家科學技術發展與研究人員需求，並經公開程序審查及建立績效評估制度。

部分研究成果及其收入要依規定撥入國家科學技術發展基金；前項基金還要編列一定比例經費推廣科學知識普及化。

政府應採取必要措施，改善科學技術人員工作條件並健全研究環境。

政府應對其雇用的特定科學技術人員給予較佳待遇、提供保險或其他必要措施，並對有研究功績者給予必要獎勵。

政府應保障科學技術人員的研究自由，但法令另有限制的情況除外。

This provision allows government agencies and government research institutions to hire science and technology personnel using open, fair qualification review methods, and exempts certain public research staff from some outside-business and side-job limits when their research work requires technology investment or concurrent work, while still requiring conflict-of-interest compliance.

The government may provide tax, financial, and other fiscal incentive measures to promote private scientific and technological research and development.

政府得對符合國家科學技術發展計畫目標的民間研究發展計畫提供必要支助。

This provision applies to science and technology that includes the humanities and social sciences, and says the government should pay attention to balanced development between those fields and other science and technology when promoting science and technology.

政府應制定科學技術資訊流通政策，並採取整體措施、建立資訊網路與系統、培育相關人才。

政府應致力推動國際科學技術合作，並促進人才、技術、設施及資訊的國際交流與利用，參與國際共同開發與研究。

政府應持續推展學校與社會的科學技術教育，以提升國民科學技術素養。

This provision says the law takes effect on the date it is promulgated.

政府應在國家財政能力範圍內持續增加科學技術發展計畫所需經費，並致力使全國研究發展經費逐年成長、達到適當的 GDP 比例。

政府應採取必要措施，持續充實基礎研究。

政府應協助相關公立學校、研究機關、公營事業、法人或團體充實人才、設備及技術，並可對表現優異的公立學校或研究機關提供設施與人才進用支援；政府也應督導或協助執行研究發展的單位，把成果轉成實際生產或利用。

This provision requires funded science-and-technology R&D projects to choose recipients by selection or review with reasons, allows research results to be owned or licensed by the executing unit, and exempts certain related matters from the National Property Act and the Government Procurement Act.

政府推動科學技術發展時，應考量政策與計畫對環境生態的影響；必要時也應提供經費，研究其對社會倫理與法律因應的影響。

科學技術研究機構與人員在推動或進行科學技術研究時，應維護環境生態、生命尊嚴及人性倫理。

政府每二年要提出科學技術發展的遠景、策略及現況說明。
