人工智慧基本法

This provision states the law’s purpose and says that where the law does not provide a rule, other laws apply.

政府應推動人工智慧研發、應用與基礎建設，規劃資源配置，並辦理相關補助、投資、獎勵、輔導與財政優惠，還要建立年度成效報告並定期公開成果與評估意見。

政府應提供 AI 相關的合理使用、扶持與補助措施，並完善研發與應用法規；主管機關也可以建立 AI 創新實驗環境。

政府應推動人工智慧相關的國際合作，並依公私協力原則，和民間一起推動人工智慧的創新運用。

政府應建立資料開放、共享及再利用機制，並提升人工智慧使用資料的品質與數量。

各目的事業主管機關在人工智慧研發及應用過程中，應與個人資料保護主管機關會商，並避免不必要的個人資料蒐集、處理或利用，同時推動個資保護納入預設與設計措施。

政府應積極利用人工智慧保護勞動者權益，縮小技能落差，並協助因人工智慧而失業者就業。

數位發展部要參考國際標準，推動人工智慧風險分類框架；各目的事業主管機關則要依需要訂定風險管理規範並協助產業制定指引與行為規範。

政府應為高風險人工智慧的應用明確責任歸屬與歸責條件，並建立救濟、補償或保險機制。

政府要檢討所主管的法規和行政措施；若不符合本法或沒有可適用的法規，應在本法施行後兩年內完成制定、修正、廢止或改善。

政府在使用人工智慧執行業務或提供服務時，應做風險評估並規劃因應措施，並依業務性質訂定使用規範或內控管理機制。

This provision identifies the competent authority: the National Science and Technology Council at the central level, and municipal/county (city) governments at the local level.

本法自公布之日起施行。

This provision defines “artificial intelligence” as a system with autonomous operation that uses input or sensing, machine learning, and algorithms to produce outputs such as predictions, content, recommendations, or decisions for explicit or implicit goals.

政府推動人工智慧研發與應用時，應兼顧公益、數位平權、創新、資安、隱私、透明、公平與責任。

This provision directs government to avoid AI uses that harm people, public order, national security, the environment, or involve bias, discrimination, misleading ads, false information, or other legal violations. It also requires high-risk AI products or systems to be clearly labeled with cautions or warnings, and calls on the Ministry of Digital Affairs and related agencies to provide or recommend evaluation tools and methods.

行政院要成立國家人工智慧戰略特別委員會，由行政院院長召集相關人士組成；委員會每年至少開會一次，遇緊急或重大事件要開臨時會，並審議國家人工智慧發展綱領。國家科學及技術委員會負責幕僚作業。

政府應持續推動人工智慧與倫理教育，並提升國民的數位素養。

政府應落實人工智慧發展政策，並鼓勵產官學界推動人才與技術的跨域合作、交流及基礎設施建置。

政府應在財政能力範圍內，編列足夠預算並採取必要措施，持續確保人工智慧政策推動所需經費到位。
