文化創意產業發展法

This provision says cultural and creative industry development is governed by this Act, but if another law is more favorable, that other law applies.

政府要推廣文化創意有價的觀念、開發運用文化創意資產，並把相關政策落實執行；中央目的事業主管機關也要訂定獎勵或輔導措施。

本條規定藝文表演票券不得高價轉售，也不得用虛偽資料或不正方式透過電腦等設備購票取票；主管機關並可協助查處、保密檢舉人資料，並可依法獎勵檢舉。

政府應開發和運用文化創意人力資源，整合教學與研究資源，並鼓勵文化創意產業合作研究與人才培訓；也可以協助地方政府、學校及相關事業充實人才。

Authorities may provide assistance, rewards, or subsidies to cultural and creative enterprises for listed business-development matters.

政府應在高級中等以下學校提供美學及文化創意欣賞課程，並辦理相關教學活動。

中央主管機關可以編列預算補助學生觀賞藝文展演，並可以發放藝文體驗券。

The government should encourage cultural and creative businesses to offer original products or services at preferential prices, with the price difference subsidized by the central competent authority.

中央目的事業主管機關可以獎勵或補助民間提供適當空間，設置創作、育成、展演等設施，供文化創意事業使用。

Government agencies may include creativity and aesthetics as evaluation items when procuring cultural and creative products or services through public selection.

主管機關應保留公有公共運輸系統場站或相關設施的一定比例廣告空間，優先提供文化創意產品或服務以優惠價格使用。

中央主管機關和政府應推動文化創意事業的投資、融資與信用保證機制，並鼓勵企業和民間資金投入。

政府應推動文化創意產業，並加強藝術創作、文化保存、文化與科技結合、城鄉及區域均衡發展、地方特色、國民文化素養與文化藝術普及。

中央目的事業主管機關得協調各駐外機構，協助文化創意事業建立國際品牌形象並拓展國際市場。

政府可出租、授權或以其他方式提供其管理的公有文化創意資產，但不得違反智慧財產權法規。

符合條件時，不動產管理機關可以直接出租公有非公用不動產，用於協助文化創意事業設置創作培育、輔助及展演場所。

A pledge over economic rights from cultural and creative works may be registered with the copyright authority; if it is not registered, it cannot be asserted against a good-faith third party, except in the listed extinction cases.

符合條件時，文化創意產品利用人可以在許可範圍內使用已公開發表的著作；主管機關也須公告、登載，並可撤銷或廢止不實或違規的許可。

The central competent authority is empowered to prescribe the enforcement rules for this Act.
