博物館法

This law is enacted to promote museum development and strengthen museum functions, professionalism, public service, diversity, education, and international competitiveness.

博物館應提升教育及學術功能，並加強與民眾溝通，以促進文化傳承、藝術推廣與終身學習。

博物館在業務需要且為促進合作交流、資源共享與整合時，得成立合作組織、建立資訊網路系統，或用虛擬博物館方式加強偏遠地區教育；主管機關及目的事業主管機關得提供必要協助。

公立博物館在因營運需要且自籌財源達一定比例時，可以依預算法設置作業基金；基金收支都要納入基金辦理，編制外人員人事支出以自籌收入30%為限。

博物館要辦理重要典藏品的專業修復或維護；符合條件時可申請補助。

公立博物館在特定珍貴稀有或瀕臨滅失的藝術品、標本、文物需要緊急搶救、修復或購置時，可以申請主管機關補助、向上級機關請撥專款，並可採限制性招標，但不得違反我國締結的條約及協定。

博物館借展並經認可展出者，在運送、保管及展出期間，不受司法追訴或扣押。

中央主管機關應建立博物館評鑑及認證制度，並可召開評鑑會處理相關評鑑與認證事宜。

博物館可就為典藏、研究、教育所需的進口物品申請關稅和營業稅免徵；公立博物館受贈特定文物等，符合審查、鑑價和備查條件時，可依規定列舉扣除或列費用，國寶捐贈還可再享特別免限制。

未辦理登記，或最近一年內曾因違反文化部博物館事業推展補助作業要點而受處理的博物館，不得獲得獎勵或補助。

中央主管機關負責訂定本法施行細則。

This provision identifies the competent authority as the Ministry of Culture at the central level, special municipal governments in special municipalities, and county/city governments in counties and cities.

This law takes effect on the date it is promulgated.

This provision defines “museum” and requires museums to serve the public; it also requires the central competent authority to prepare and periodically review a museum development policy white paper and to build a museum statistics database.

博物館應依其宗旨和發展目標辦理蒐藏、保存、修復、維護、研究、展示、人才培育、教育推廣、公共服務及行銷管理等業務。

This provision classifies museums as public or private, requires private museums to apply to the local competent authority, exempts museums already established before the law took effect from that application rule, and requires the authority to survey and assist unregistered museums with museum potential.

中央目的事業主管機關應設置原住民族博物館，並推動原住民族文化永續發展。

中央主管機關要依博物館設立目的、規模、典藏、研究、展示及文化教育功能，訂定分級輔導辦法；主管機關及目的事業主管機關並應對依法登記的公、私立博物館提供諮詢、技術協助、人才培育規劃與經費補助。

公立博物館應依規模、特色與功能妥善編制人事，並配置館長、副館長及其他職稱人員；必要時，得比照教育人員資格聘任。

博物館要確認蒐藏品來源與取得方式的合法性，並訂定典藏管理計畫；公立博物館還要把計畫報主管機關備查。
