公民與政治權利國際公約及經濟社會文化權利國際公約施行法

This law is enacted to implement the two UN human rights covenants and strengthen Taiwan’s human rights protection system.

The human-rights protections stated in the two covenants have domestic legal effect.

適用兩公約時，應參照其立法意旨及兩公約人權事務委員會的解釋。

各級政府機關行使職權時，應遵守兩公約的人權保障規定，避免侵害人權，保護人民不受他人侵害，並積極促進人權實現。

Government agencies must plan, promote, and carry out matters under the two covenants, coordinate when responsibilities overlap, and the government must cooperate internationally to protect and promote human rights.

政府應依兩公約規定，建立人權報告制度。

各級政府機關應依財政狀況，優先編列執行兩公約保障人權所需經費，並逐步實施。

各級政府機關應依兩公約內容檢討其主管法令與行政措施；如有不符，應在本法施行後二年內完成制定、修正、廢止及改進。

本法的施行日期由行政院决定。
