公職人員利益衝突迴避法

This provision states that the law on recusal for public officials’ conflicts of interest applies, unless another law imposes stricter requirements.

在迴避情形下，民意代表不得參與相關議案的審議與表決；其他公職人員應停止執行該職務，並由代理人代行。

相關機關團體及上級、指派、遴聘或聘任機關，應在每年結束後30日內，彙報前一年度公職人員自行迴避、申請迴避及職權迴避情形。

公職人員不得利用職務上的權力、機會或方法，為自己或關係人謀取利益。

公職人員之關係人不得用請託關說或其他不當方法，向受公職人員服務或監督的機關團體人員謀取自己或公職人員的利益。

公職人員或其關係人，原則上不得與其服務或受監督的機關團體進行補助、買賣、租賃、承攬或其他有對價的交易，但列舉情形除外。

為調查公職人員及其關係人違反本法情事，監察院、法務部及相關政風機構得向機關、法人、團體或個人查詢；受查詢者有據實說明或提供必要資料的義務。

違反第六條第一項，或依第八條或第九條命迴避而不迴避者，會被處罰鍰；後者還可按次處罰。

Violating Article 12 or Article 13(1) can result in an administrative fine.

Violations of Article 14(1) are fined on a sliding scale based on the transaction or subsidy amount; violations of Article 14(2) are fined NT$50,000 to NT$500,000 and may be penalized repeatedly.

If a queried person has no justifiable reason to refuse or give false explanations/provide false statements, a fine applies; if they still refuse after a deadline notice to cooperate, they may be fined again for each occurrence.

This article defines who counts as a “public official” under the Act, including listed officeholders and certain people acting as temporary substitutes while performing the post.

本條規定第16條至第18條的罰鍰，由監察院或法務部依對象分工處罰；依法代理執行公職人員職務的人員也適用同樣分工。

裁處罰鍰確定後，處分機關要把資訊刊登在政府公報，並公開到電腦網路。

本法的施行細則由行政院會同考試院、監察院訂定。

公職人員知道有利益衝突時，應立即自行迴避；並且要依身分以書面通知相關機關。

利害關係人可向有管轄的機關團體申請公職人員迴避；機關若無收件權限，應移送並通知申請人。

受通知或受理的機關團體要依判斷結果，命公職人員繼續執行職務或命其迴避。

相關機關在知道公職人員應自行迴避卻未迴避時，應依職權命其迴避。
