聯合國反貪腐公約施行法

This provision says the law is enacted to implement the 2003 United Nations Convention against Corruption.

The provision says the rules announced by a treaty have domestic legal effect, and that international-law obligations should be carried out according to a treaty; if there is no treaty or the treaty does not address the matter, reciprocity applies.

This provision says anti-corruption laws should be read with reference to the UN Convention against Corruption implementation guide and the decisions of the Convention’s States Parties.

各級政府機關在行使職權時，應符合公約規定，並積極推動反貪腐法制及政策的落實。

各級政府機關要依現行法令分工，負責籌劃、推動與執行公約事項；遇到跨機關事項時，機關之間要協調辦理。政府也要與各國政府及相關國際、反貪腐機構合作，以落實反貪腐法律架構。

政府應定期公布反貪腐報告，且報告須包含相關分析與有效性評估。

各級政府機關要依公約內容檢討其主管的法令與行政措施；若有不符公約者，須在本法施行後三年內完成制定、修正或廢止及相關改進。

本法的施行日期由行政院 तय定。
