非常時期農礦工商管理條例

In an emergency, the Ministry of Economic Affairs may designate listed enterprises and goods, subject to Executive Yuan approval, for regulation under this statute.

符合前兩條命令且確實無資力復業、復工或遷移的人，除依第二十五條規定外，可以準用第五條。

指定各企業之員工不得罷市、罷工或怠工。

指定的企業及物品之生產者或經營者，不得從事投機壟斷或其他操縱行為。

經濟部得因必要，對指定物品的進出口分別加以限制或禁止。

經濟部得依供求情況，分別調節指定物品的消費。

經濟部得因必要，對指定物品分別作出禁售或平價處分。

經濟部在必要時，可以命令生產者或經營者儲藏或移置指定物品。

經濟部在非常時期需要時，可以按公平價格收買指定物品的全部或一部。

經濟部得因必要，命指定企業增資、合併或縮減範圍。

經濟部可命符合特定情形的企業停業，並可將停業企業的土地、房屋、機器、動力、材料、工具等改作其他用途。

If a management matter under this statute involves another ministry’s responsibilities, the Ministry of Economic Affairs handles it in coordination with that ministry. For designated enterprises or goods, the Ministry may directly order or coordinate to have local authorities manage them separately.

經濟部可以對製造奢侈品或其他非必要的企業，分別予以限制或禁止。

For specified enterprises that need technical or managerial improvement, the Ministry of Economic Affairs may take over management if the enterprise does not improve after being ordered to do so.

If a company’s existing equipment can be converted into items related to military use, the Ministry of Economic Affairs may order that conversion.

經濟部在必要時，可以命農業生產者變更耕作物種類。

The Ministry of Economic Affairs may, when necessary, order reporting of experiments, bar publication or disclosure, and take over the invention or patent for government use or joint government investment.

經濟部得視需要，對指定企業提供協助。

經濟部應隨時協助並便利由戰區或鄰近戰區自動遷移的企業或物品，並且可以予以保障。

經濟部可以設置調整機關，分別辦理前二條所規定的協助事項。

If a loss is caused by the listed government measures, compensation must be provided.

對指定企業或物品實施列舉行為之一者，會被處無期徒刑或七年以上有期徒刑；未遂犯也處罰。

經濟部可以就指定的企業或物品，另設機關負責管理事項。

Violating Article 11 by striking, closing shop, or inciting those acts can lead to up to 7 years’ imprisonment and an additional fine of up to 1,000 yuan. Idling or inciting idling can lead to up to 1 year’s imprisonment or detention.

A person who violates Article 12 and engages in speculative, monopolistic, or other manipulative conduct may be imprisoned for up to 5 years and fined 1 to 3 times the illicit benefit.

違反本條列舉命令的人，可能被處一年以下有期徒刑、拘役或一千元以下罰金。

If an offence under any of the previous four articles also falls under another law, the harsher punishment rule in that other law applies.

Pre-existing laws and regulations on agriculture, mining, industry, and commerce that do not conflict with this article continue to apply.

本條與第三條、第二十七條所定的機關組織，另由法律規定。

This provision says the statute takes effect on the date it is promulgated.

經濟部在非常時期、經行政院核准後，得將特定礦業、軍用品製造工業及電氣事業收歸政府辦理，或由政府投資合辦。

經濟部在為配合非常時期的生產需要時，可以對私有荒地強制使用或徵收。

經濟部可以依各地需要，隨時分別按種類與地域直接經營指定的、屬生活日用必需的企業或物品。

指定企業及其生產者或經營者，未經經濟部核准，不得歇業、停業或停工；已歇業、停業或停工者，經濟部得限期命其復業、復工。

經濟部在戰區或鄰近戰區，必要時可命指定企業分別遷移。
