礦場安全法

This law is enacted to prevent mine disasters and maintain mine safety; matters not covered by it are governed by other related laws.

The mine-right holder must provide safety equipment, funds, and personnel for mine safety measures, and the mine manager is responsible for designing, managing, and maintaining those safety matters.

礦業權者必須指定礦場負責人並報主管機關核備；變更時也要同樣辦理。

礦業權者必須遴用礦場安全管理人員並報主管機關核備；礦場負責人也必須在管理人員無法執行業務時，立即指定合格人員暫代。

礦業權者在特定水域或舊採掘跡附近坑內採礦時，必須擬定安全開採計畫，附圖送主管機關核定後才能實施；計畫變更時也一樣。

礦業權者要為礦場作業人員辦理在職訓練，並對新進人員實施職前訓練；礦場負責人不得讓未受前述訓練的新進人員從事礦場作業。

礦業權者在採礦時，必須在礦坑與地表間設置入風井和出風井，且兩者要有適當風道連絡。

礦業權者必須就礦場的通風、溫度和濕度設置適當的調節設施，並備有檢查及控制儀具。

礦業權者必須在礦場儲備足夠的保坑與應變材料、設備。

礦業權者在廢棄礦坑前，須先報主管機關核准，並採取必要的安全措施。

礦場負責人應在礦場設立礦場安全單位，建立安全檢查制度，並將其編制報主管機關核定。

“礦場”是指探礦、採礦及其附屬的選礦、煉礦作業場所。

礦場負責人必須讓礦場內危險性機械、器具、其他器材及爆炸物經檢驗合格，並依相關規定裝設與使用。

礦場負責人應依礦場實際狀況需要訂定礦場安全守則，並報主管機關核備後公告。

礦場負責人必須繪製礦場安全圖，並設置礦場安全日誌及其他應備圖表與作業人員名冊。

礦場安全主管負責礦場安全單位、監督安全管理人員，並處理相關技術及行政事務；各種礦場安全管理人員的職責範圍由礦場負責人訂定，變更時也要一併報主管機關核備。

礦場作業人員必須遵守與礦場安全有關的法令規定。

礦場作業人員在作業時，必須佩帶必要的安全防護裝備。

前二條規定也適用於進入礦場執行公務、做臨時工作，或前往參觀、實習、探訪的人員。

礦業權者必須在礦場設置坑內、坑外通訊連繫和警報系統，並在適當地點設置危險與緊急避難標誌。

礦業權者在礦場發生災變時，應立即採取救人措施；除非救護無望、會明顯危害救護人員，且經主管機關所派人員許可，否則不得放棄救人措施。

礦場負責人必須使礦場的醫療、衛生設備及措施保持適當的作業狀態。

The provision defines mineral-right holders as exploration-right holders and mining-right holders, and says an operator takes on the responsibilities of the mineral-right holder when a mineral right is lawfully approved and handed over for operation by entrustment, lease, or cooperation.

礦場負責人必須讓礦場的急救、救護等組織與設備保持應變狀態，並定期進行檢查和演習。

礦場負責人和礦場安全管理人員在發生災變或有災變之虞時，應立即採取必要的應急或救護措施，並立即向主管機關速報。

礦場負責人為礦場安全緊急應變時，必要時可以命作業人員進入並暫時使用他人土地；若因此使土地所有權人或占有人受損害，礦業權者應給予相當賠償。

The competent authority must set up a rescue station in concentrated mining areas and regularly help mines train mine rescue teams.

主管機關應定期派員檢查礦場安全設施；發現不合格時，應指導並限期改善，必要時還可暫時停止工作。

主管機關在認為礦場因礦業工程或災變足以危害相關人員或資源時，可以命令礦業權者局部或全部停止開採；如無法改善或控制，也可以命令局部或全部封閉，必要時還可撤銷礦業權。

主管機關派任的礦場安全監督員，遇到礦場有危險或可能有危險時，應立即命令相關人員採取必要的應變或預防措施。

主管機關接到礦場災變報告且認為必要時，應立即指派礦場安全監督員到現場督導救助、指導復工並鑑定責任。

主管機關應設置礦場安全諮議委員會，委員會就主管機關交議的礦場安全事項進行研議並提出建議。

主管機關有權訂定礦場安全監督員的資格及任免管理辦法。

本條是在定義「礦場負責人」：指實際綜理礦場業務的人。

If a person falls within any of the listed situations, they may be punished with imprisonment of up to five years, detention, or a fine of up to NT$50,000, or both.

If a person violates the listed provisions or ignores certain orders issued by the competent authority, the person may be punished with imprisonment up to 3 years, detention, or a fine up to TWD 30,000, or both.

If any listed violation occurs, the actor may be punished with up to one year’s imprisonment, detention, and/or a fine of up to NT$10,000.

If someone violates certain listed articles, the competent authority may impose a fine of TWD 5,000 to 20,000.

前條所處的罰鍰，可以移送法院強制執行。

如果礦業權者是法人，且其代表人、代理人、礦場負責人、礦場安全管理人員或礦場作業人員犯第四十條到第四十二條的罪，除處罰行為人外，該法人也要依各該條被科罰金。

主管機關有權訂定本法的施行細則。

本條定義「礦場作業人員」為從事第二條所稱礦場工作的工作人員。

主管機關是經濟部；必要時，主管機關可以委託直轄市或縣（市）政府辦理本法有關事項。
