土石採取法

申請土石採取許可時，申請人要向直轄市、縣（市）主管機關檢附指定文件；文件不齊全的，不受理。

前條所指的土石採取計畫書圖，必須載明採取計畫、水土保持及環境維護措施、整復維護措施、運輸計畫、公共設施維護計畫，以及相關圖資與主管機關要求的其他事項或文件。

Regional map location boundaries, area, and the depth referred to in Article 7(2) must be measured using the measurement method announced by the central competent authority.

主管機關應審查土石採取許可申請文件；若記載不完備，應通知申請人於30日內補正，逾期未補正或補正不完全者得駁回申請。

直轄市、縣（市）主管機關審核土石採取許可案時，應會同相關機關實地勘查；經依法審核沒有違反主管法令情事，並報中央主管機關審核後，才核發土石採取許可證。

土石採取人申請展限時，原則上要在期限屆滿前6個月提出；如果土石採取許可期限在1年以內，則要在期限屆滿前2個月提出。

The rules in Articles 10 and 13 to 15 apply, as applicable, to applications to extend a soil and rock extraction permit.

土石採取人須在領得許可證後6個月內，備齊文件向地方主管機關申請土石採取場登記證，核准後才能開工。

土石採取人申請核發土石採取場登記證前，應先設妥界樁及牌示，並妥為保存與維護；其規格由中央主管機關訂定。

土石採取人必須依核定的土石採取計畫採取土石，並辦理水土保持、環境維護、整復及防災措施。

已核定的土石採取計畫在特定原因下變更，須報請直轄市、縣（市）主管機關核准；主管機關也可為保護水道、水土保持及土地整體有效利用，逕行變更計畫；土石採取人因變更受損失時，可請求合理補償。

土石採取人申請土石採取區減區或更正時，應檢具書件並向直轄市、縣（市）主管機關辦理。

If a gravel extraction permit was obtained unlawfully, the municipal or county competent authority must revoke the permit.

土石採取人符合列舉情形之一時，直轄市、縣（市）主管機關可報請中央主管機關審核後，廢止土石採取許可。

When a soil and stone extraction permit is revoked or abolished, the related permit certificate and site registration certificate must be cancelled.

土石採取人於土石採罄或不再繼續經營時，應先依核定計畫與相關法令完成整復，然後向直轄市、縣（市）主管機關繳銷相關許可證與登記證。

土石採取許可到期、撤銷或廢止時，土石採取人必須依原核定的計畫書圖及相關法令辦理整復。

土石採取人於土地使用完畢或停止使用並完成整復後，如土地所有權人受有損失，應按損失程度給予相當補償。

土石採取人 must appoint a site responsible person and a technical supervisor, and report them to the local competent authority for filing; the same applies when there is a change.

土石採取原則上要依本法取得許可；列出的六種情形不在此限。

土石採取人要提供採取場安全所需的設備、經費與人員，並依勞工安全衛生法令採取指定安全措施；採取場負責人還要負責這些措施的設計、管理與維護。

土石採取場負責人遇到災變時，除依其他法令辦理外，應在24小時內向直轄市、縣（市）主管機關速報，並由其轉報中央主管機關；若有立即危險，應立刻停工並讓作業人員撤到安全場所。

土石採取人要定期申報採取及銷售數量，由直轄市、縣（市）主管機關轉報中央主管機關備查；中央主管機關也要定期調查這些數量。

主管機關可以劃定土石禁採區；受損的土石採取人可以請求補償，且部分情況下地方主管機關與土石採取人還有後續廢止、重新申請許可與補件義務。

地方主管機關應對土石採取場做安全檢查；不合規定時要限期改善，未改善或有災變風險時要通知停工。

土石採取場負責人在土石外運時，須開具出貨三聯單交運送人隨車攜帶，並使土石裝載於專用車輛或專用車廂；少量土石的運送可不受第二項限制，標準由中央主管機關訂定。

未經許可採取土石會被罰鍰；若在特定水域用船舶或機械設備採取土石，還可能面臨徒刑、併科罰金，以及工具沒收。

如果不遵行直轄市、縣（市）主管機關依第34條第1項通知的全部或一部停工命令，會被處罰鍰。

未依第26條或第27條辦理整復者，會被罰鍰並命限期整復；必要時，主管機關還可代為整復及清除設施，費用由土石採取人負擔。

違反本條列明的土石採取與安全措施要求者，會被處新臺幣50萬元至250萬元罰鍰。

This provision defines key terms used in the law about土石 and土石採取.

有兩種情形會被罰鍰：土石採取場發生災變時未依規定速報直轄市、縣（市）主管機關，或拒絕、規避、妨礙依法進行的檢查。

符合列舉情形之一者，會被處新臺幣3,000元以上、30,000元以下罰鍰。

If unlawful gains exceed the statute’s maximum fine, the fine may be increased within the amount of those gains and is not limited by the statutory cap.

Cases involving violations of this law that also involve other criminal liability are referred to the judicial authorities for handling.

直轄市、縣（市）主管機關受理許可、勘查、登記或核發證照時，應收取相關費用；收費基準由中央主管機關訂定。

中華民國人可以依本法申請土石採取許可。

中央主管機關負責訂定本法所需各種書表及證照的格式。

中央主管機關應定期抽查本法所定直轄市、縣（市）主管機關辦理事項。

中央主管機關負責訂定本法施行細則。

本法自公布日開始施行。

Gravel extraction permits are limited to three years for river and water areas, and ten years for on-land, coastal, and sea areas; extensions after expiry are not allowed for the river and water-area permits, and the second rule is stated as applying similarly but is ambiguous in isolation.

申請土石採取區域時，面積不得超過法定上限；相關採取深度標準由中央主管機關會同相關機關訂定並公告。

主管機關可以在特定條件下劃設土石採取專區；專區內的申請、土地處理和許可程序也有指定規則。

河川內土石採取案件，需由直轄市或縣（市）主管機關受理後，會同河川管理機關共同會勘；取得使用河川許可書後，再由該主管機關核辦並轉發。

如果申請的土石採取區土地是公有地，土地管理機關可以出租或同意使用，並可收取租金或使用費。
