事業用爆炸物管理條例

This provision states the statute’s purpose: to manage industrial explosives, prevent disasters, and maintain public safety.

Explosive materials sales businesses must submit a written application for permit to the central competent authority when setting up, and must seek approval before opening a branch office.

爆炸物販賣業者若在取得籌設許可後一年內無正當理由未開業，或開業後停業滿一年，中央主管機關得廢止其許可；核准增設營業分處所後也適用同樣規則。

Explosives may only be sold to people who have obtained the purchase certificate under Article 14.

爆炸物製造、販賣業者須先設置安全設施並通過中央主管機關查驗，才能開工或營業，也要回報開工或營業日期。

爆炸物購買者原則上限於特定業務用途者；申請購買時要填申請書，向主管機關申請核配並核發配購證。

爆炸物輸出或輸入時，必須每次填寫申請書，寫明種類、數量、輸出入港口或機場，並向中央主管機關申請核准。

運輸爆炸物時，原則上要逐次填寫申請書，向中央主管機關申請核發爆炸物運輸證；但在製造廠、礦場或工區內運輸時，可免申請。

運輸爆炸物時，須用專車並由專人押運，依核定路線與時間行駛；進入都市地區時，還要檢附運輸證並向當地警察機關申請前導通行或交通疏導。

爆炸物只能由受過爆破專業訓練的人員使用，並且要依規定領用、存放、點交、裝填、引爆與處理殘留物。

Explosives must be stored in a powder magazine, but explosives needed that day may be temporarily kept in a safe place at the workplace if watched by a designated person.

爆炸物的製造、販賣業者及購買者，除經第二十一條規定核准者外，必須設置火藥庫和看守房，並派駐專人或輪值人員。

爆炸物販賣業者及購買者在特定鄰近情況下，經中央主管機關核准後，可以把爆炸物寄存在他人的火藥庫。

火藥庫的設置或變更要先申請主管機關勘查核准；興建完成後，查驗合格並取得登記證後才可以使用。

爆炸物變質或不堪使用需要廢棄處理時，爆炸物販賣業者或購買者應填具廢棄申報書，並向中央主管機關申請核准。

爆炸物購買者除緊急需要外，未經中央主管機關許可，不得將申購的爆炸物移作他用；作業結束後如有剩餘或不再使用，應申報並經中央主管機關核准後處理。

Explosives manufacturers, sellers, and purchasers must appoint an explosives manager. That manager must complete the required training, pass it, and have work experience; the central competent authority sets related rules.

Certain people may not serve as explosives users or explosives managers, and the central competent authority may order replacement of dealers or buyers in some revocation cases.

爆炸物管理員不能執行職務時，遴用單位負責人要安排代理人，並在請假達一定天數或離職時，依規定辦理報備與接替。

In an explosives manufacturing plant, powder magazine, or place of use, smoking, using fire, or bringing in flammable or ignitable substances is prohibited, unless another law or regulation provides otherwise.

主管機關在認為可能發生災害或已發生災害時，為防止災害並維護公共安全，可以命令爆炸物製造、販賣業者或購買者採取緊急措施。

If someone causes public danger by illegally starting production of explosives without passing inspection, or by illegally discarding or treating explosives, imprisonment applies.

Certain violations related to explosives activities are subject to a fine of NTD 200,000 to NTD 1,000,000, with an order to correct the violation; if not corrected by the deadline, repeated fines may be imposed.

列舉多種違反爆炸物相關安全規定的情形，會被罰新臺幣6萬元以上30萬元以下，並限期改善；逾期未改善，得按次連續處罰。
