地質法

This law is enacted to improve the geological survey system, manage national land geological data effectively, and build basic geological information for land environmental change and land resource management.

從事基地地質調查及地質安全評估時，原則上應由具備法定執業資格的相關技師辦理並簽證。

符合第八條第一項者，送審文件中要納入地質調查與地質安全評估結果；審查機關原則上要找地質專家學者或執業技師參與，或委託專業團體辦理審查。

主管機關可以為監測和研究地質災害的發生而設置地質觀測設施。

在施工或使用階段，相關土地的開發人、經營人、使用人或所有人，應防範地質災害發生。

主管機關或目的事業主管機關可以委託專業技師或相關機關（構）進行地質災害的調查與鑑定；受委託者的資格、條件及作業辦法由中央主管機關訂定。

主管機關可以派查勘人員進入公、私有土地做必要的地質調查、設施設置或災害鑑定；在特定地質災害情況下也可以進入，但土地所有人、使用人及管理人不得拒絕、規避或妨礙。

中央主管機關及各中央目的事業主管機關可以就地質敏感區的防治措施，按年編列計畫與預算辦理。

進行地質調查或土地開發相關作業的人，通常要把地質資料提供給中央主管機關，並在一定期限內保存原始地質資料；中央主管機關也可以通知提供原始資料、同意例外不提供，並建立資料庫公開或提供資料。

中央主管機關 must conduct geology and related research. Local special municipality or county/city competent authorities may also conduct that research, and competent authorities may entrust agencies, organizations, schools, or individuals to perform it.

主管機關為推廣地質教育、提升全民對地質環境的認識，可以獎勵機關（構）、團體、學校及個人從事地質推廣教育活動。

This provision defines the competent authority under the law.

Anyone who evades, obstructs, or refuses a geological survey or geological disaster identification carried out by the competent authority under Article 15(2) may be fined between TWD 100,000 and TWD 500,000.

If a person violates Article 17(1) or (2) and still fails to provide geological data after being notified by the central competent authority to do so within a time limit, a fine of NT$10,000 to NT$50,000 may be imposed, and repeat penalties may also be imposed.

本法的施行日期由行政院决定。

中央主管機關應辦理全國地質調查，以建立全國地質資料，並至少每五年通盤檢討一次調查內容。

The central competent authority must designate certain geologically sensitive areas, set up a review committee, and make rules for designation and committee operations. In designated geological relic or landslide sensitive areas, ground-mounted or water-surface solar PV systems are generally not allowed, subject to stated exceptions.

主管機關應將地質敏感區資料納入土地利用、開發審查、防災、環境保育與資源開發的參考；若依主管法令作業而使現有土地受管制，補償依該法令辦理。

主管重大公共建設的機關，在規劃和選址時，應先知會主管機關；重大公共建設的定義由中央主管機關會同相關機關訂定。

在地質敏感區內進行土地開發前，應先做基地地質調查及地質安全評估；緊急救災不適用。

進行基地地質調查及地質安全評估者，應視情況在兩種方法中擇一辦理：查核現有資料，或進行現地調查，並都要評估地質安全。
