光碟管理條例

光碟管理依本條例規定；本條例沒有規定的部分，適用其他相關法律。

Businesses manufacturing pre-recorded optical discs must apply to the competent authority for a source identification code before manufacturing, imprint that code on the discs, and avoid false marking.

製作相關母版前，事業要先向主管機關申請核發來源識別碼；母版也要壓印標示該識別碼，且不得虛偽不實標示。

製造機具在輸出或輸入前，應先向主管機關申報。

主管機關可以出具查核公文，派員進入相關製造場所查核並要求提供資料；場所負責人或從業人員不得規避、妨礙或拒絕。

主管機關可以委任、委託或委辦其他行政機關，辦理相關許可、核發、申報與查核事項。

未經許可製造預錄式光碟者，會被命令停工、限期申請許可並處罰鍰；屆期不改還可能加重處罰，甚至有刑責。未申報製造空白光碟者，則須限期申報並可能按次受罰。

違反第九條、且未依製造許可文件所載場址製造預錄式光碟者，會先被命令停工並處罰鍰；若拒不遵從，會再命令停工並加重罰鍰；仍不遵從者，還可能被判處有期徒刑、拘役或罰金。

違反指定的來源識別碼規定時，可能被命令停工並處以罰鍰；情節持續或再犯時，罰鍰加重，並可能進一步面臨有期徒刑、拘役、罰金、沒入成品或半成品，以及製造許可廢止。

違反第六條第二項或第三項相關規定者，會先被限期 15 日內補辦或改正；逾期未辦理，會被罰鍰，並可持續按次處罰直到完成。

If a person violates Article 8 by not retaining data, they are fined NT$1.5 million to NT$3 million and ordered to correct the violation within 15 days.

This provision defines key terms used in the statute, including types of discs, master plates, source identifiers, businesses, manufacturing, and manufacturing equipment.

A business that commits any of the listed violations is fined NT$1.5 million to NT$3 million; if it negligently violates Article 11(2) and can produce rights-holder authorization documents, the fine is reduced to one-third.

未申報或申報不實而輸出或輸入製造機具者，會被罰鍰，並須在15日內補辦登記。

If a person violates Article 13 by evading, obstructing, or refusing inspection, they are subject to a fine of NT$1.5 million to NT$3 million.

在本條例施行前已輸入的預錄式光碟製造機具，其所有權人應於施行日起6個月內向主管機關申請備查。

輸出未壓印來源識別碼的預錄式光碟，若被海關查獲，海關可依規定處以罰鍰、沒入光碟，並檢樣通知主管機關處理。

A fine under this provision must be paid within three months; if it is not paid on time, it is referred for compulsory execution.

Businesses that were already manufacturing pre-recorded optical discs before the Act took effect must apply to the competent authority for a manufacturing permit within six months; businesses already manufacturing blank optical discs must report to the competent authority within six months.

先前已有其他非主管機關核發識別碼的事業，必須在本條例施行日起 6 個月內向主管機關申請備查。

本條例自公布日開始施行。

本條規定，本條例所稱的主管機關是經濟部。

事業製造預錄式光碟前，須先向主管機關申請許可，並在核發許可文件後才可製造；事業製造空白光碟前，則應事先向主管機關申報。

主管機關在事業依前條第一項申請許可時，如符合列出的任一情形，應不予許可。

預錄式光碟製造許可文件要載明指定事項；相關事項變更時，事業要先申請變更，並把許可文件明顯揭示在場址。

主管機關在發現申請許可資料有重大不實情事時，得撤銷已取得的預錄式光碟製造許可。

事業必須保存預錄式光碟相關資料，至少三年。

Businesses manufacturing pre-recorded optical discs must do so at the site stated in the manufacturing permit document.

符合條件的事業可以製造、持有或輸出經國外合法授權製造、專供輸出的預錄式光碟；但這類光碟不得在我國散布、播送或販賣。
