About this statute
This provision says certain acts count as infringement of trade secrets, including obtaining a trade secret by improper means, or obtaining, using, or disclosing it in specified knowledge or negligence situations. A victim may ask for a trade secret infringement to be stopped, prevented if there is a risk of infringement, and for infringing or infringement-use items to be destroyed or otherwise dealt with. 因故意或過失不法侵害他人營業秘密的人,負損害賠償責任;數人共同侵害的,負連帶賠償責任。 Using, disclosing, copying, stealing, or otherwise improperly obtaining trade secrets for unlawful gain or to harm the owner can be punished by imprisonment, detention, and possibly a fine. If conduct intended for use in a foreign area, mainland China, Hong Kong, or Macao falls within the listed offences from the preceding article, the offender is punished by 1 to 10 years’ imprisonment and may also be fined TWD 3 million to TWD 50 million. Attempted offences are also punishable.
