This provision states the Act’s purpose and says that matters not covered by the Act follow other laws.

Certain non-import/export-purpose entities or individuals may handle import/export of specific goods under Ministry of Economic Affairs International Trade Bureau rules.

貨品原則上應可自由輸出入；但在條約、協定或特定公共利益需要下，可以限制。

Military agencies that import or export goods are managed under regulations set by the Ministry of Economic Affairs together with the Ministry of National Defense, and the goods are included in import/export statistics.

This provision restricts strategic high-tech goods and gives the competent authority power to announce controlled goods/areas, detain goods, delegate detention to customs, and set detailed rules.

瀕臨絕種動植物及其產製品的輸出入受管制：輸出原則上要先取得主管機關許可，輸入原則上要有出口國許可文件。

經濟部國際貿易局可以委託金融機構、同業公會或法人辦理特定進出口管理事項；受託者須接受監督，必要時還要到立法院備詢。

持有輸出入許可證的出進口人，輸出入貨品時要依許可證內容辦理。

出進口人申請或提出出進口文件時，可以用電腦連線或電子資料傳輸方式辦理。

主管機關可就進出口配額訂定管理規則；受配額限制的進出口人不得做出偽造文件、違規轉口、逃避查核等行為，無償配額原則上也不得轉讓。

出進口人不得從事列舉的七類不當行為。

民眾可以提供事實或證據，向主管機關檢舉進口人產地標示不實；主管機關可給予檢舉人獎勵，且須保密其身分。

If imports increase and cause serious injury or a serious threat to a domestic industry, certain parties may apply for an industry-injury investigation and import relief.

在符合特定損害條件並經經濟部調查成立時，財政部得依法對進口貨品課徵平衡稅或反傾銷稅。

This provision defines “trade” as the import and export of goods and related matters, and says goods include attached trademark, patent, copyright, and other legally protected intellectual property rights.

主管機關可以補助法人、團體或商號辦理推廣貿易業務；並應在特定規模條件下於其他國家主要貿易展覽場、館設置臺灣產品館（區）。

受外國政府委託在我國執行裝運前檢驗者，其檢驗業務受主管機關監督；相關爭端解決小組的決定對裝運前檢驗機構及出口人有拘束力；並由經濟部訂定監督管理辦法。

經濟部國際貿易局可依出口需要簽發原產地證明書或加工證明書，並可收費；必要時也可委託其他機關或團體辦理。部分團體對出口貨品也可簽發，但公告且屬特定原產地證明書者，未經核准不得簽發。

符合資格者在輸出入貨品需要下可以自行簽具原產地聲明書，但不得作不實聲明、違反原產地認定基準，且要保存相關文件。

The competent authority may set up a trade promotion fund, customs may collect a trade promotion service fee on import/export goods up to 0.0425% of the goods’ price, and some cases may be exempt.

For collecting the promotion trade service fee, exported goods use the FOB price, imported goods use the dutiable price, and if imported goods are valued using repair, assembly, processing, rental, or use fees, the estimated dutiable price is used.

符合列舉情形的輸出入貨品，可以向海關申請退還已繳納或溢繳的推廣貿易服務費；退還金額不超過新臺幣一百元的，不予退還。

主管機關應協助出進口廠商，並可主動透過與外國諮商或談判，排除其在外國市場遭遇的不公平貿易障礙。

為因應貿易推廣需要，行政院可以指定有關機關推動輸出保險、出進口融資、航運發展及其他配合輔導措施。

經濟部國際貿易局因管理需要，得通知出進口人提供業務文件或資料，必要時並得派員檢查；出進口人不得拒絕，但檢查人未出示證明文件時，被檢查者得拒絕檢查。

業務上知悉或持有他人貿易文件或資料、且該資料足以妨礙他人商業利益的人，原則上應保守秘密。

出進口人要本著誠信，透過仲裁、調解或和解積極處理貿易糾紛；主管機關要推動國際貿易爭議的仲裁制度。

Exporting strategic high-tech goods to a controlled area without permission, diverting them there before import, or changing declared use/end user after import without permission can be punished with imprisonment, detention, and/or a fine. If business personnel commit the offence, the corporation or natural person may also be fined.

If one of the situations listed in the previous article applies, the Ministry of Economic Affairs International Trade Administration may stop export, import, or import/export of goods for one month to one year, or revoke the importer/exporter registration.

違規輸出入戰略性高科技貨品者，經濟部國際貿易局得裁處罰鍰、停止輸出入或廢止登記；特定違規貨品，主管機關得沒入。

違規的出進口人或相關團體，經濟部國際貿易局可以警告、罰鍰、停業/停權，情節重大時還可廢止登記或停止簽發、簽具原產地文件資格。

對符合特定第十六條情形的出進口人，經濟部國際貿易局得依情節處以罰鍰、停止配額相關權利、收回配額，嚴重時並可廢止登記；稽查期間還可暫停讓出或凍結配額使用。

This provision defines “出進口人” as an exporter/importer business registered under this law, or a person handling import/export of specified goods for purposes other than import/export itself.

經濟部國際貿易局得在特定情形下停止出進口人的輸出入貨品；停止原因消失時，應立即回復。

Certain exporters/importers under an export-import suspension may still carry out shipment for transactions already entered into before the penalty, if the Ministry of Economic Affairs International Trade Administration verifies the transaction as true.

People sanctioned under the listed provisions may file an objection and request reconsideration with the International Trade Bureau; the Bureau must decide within 20 days after receiving the objection letter.

This provision is deleted.

經濟部補助超過半數年度經費的同業公會或法人，其人事及經費應受經濟部輔導監督；必要時，並須赴立法院備詢。

主管機關有權訂定本法施行細則。

This provision says the law takes effect on the date it is promulgated, with stated exceptions.

本法的主管機關是經濟部；如果規定事項涉及其他部會或機關的職掌，主管機關要會商相關機關辦理。

主管機關可在國家安全目的下，會同相關機關報請行政院核定，禁止或管制與特定國家或地區的貿易；發布後一個月內要送立法院追認。

在列舉情形下，主管機關可以暫停特定國家、地區或特定貨品的輸出入，或採取其他必要措施；原因消失時應立即解除。

主管機關或其指定機關可就對外貿易事務與外國談判、簽署協定或協議；特定情況下須先協調、報核或送議決，且涉及修法的內容要完成立法程序才生效。

Before foreign negotiations and agreement signing on economic and trade matters, the competent authority or an agency designated by the Executive Yuan may, if needed, hold a public hearing or consult scholars, experts, and relevant businesses.

公司、商號經登記為出進口廠商後，可以經營輸出入業務；申請前要先向經濟部國際貿易局預查英文名稱，核准後可保留六個月。

符合前一年出進口實績達一定標準的出進口廠商，可以被表揚；表揚辦法由主管機關訂定。
