標準法

This provision states the law is enacted to establish and promote common standards and standardization, improve quality and efficiency, and support public welfare.

標準專責機關可以依職權或申請，經審查委員會審議後，選定國家標準項目並實施驗證業務；必要時也可以取消該選定。

A manufacturer may apply for verification of selected national standard items, and the standard-specialized authority may approve use of the standard mark if verification requirements are met. Use of the mark is otherwise prohibited, and approval may be revoked for violating the use-management rules.

申請使用正字標記的人要繳費；已核准使用且在使用期間接受查核的人，也要繳納查核相關費用。

主管機關可以訂定獎勵辦法。

主管機關可以委託非營利的標準化認證機構辦理認證業務，並由主管機關訂定標準化及認證的實施辦法。

標準專責機關應設置或指定查詢單位，並提供與標準或驗證事項相關的文件與資訊服務。

Unauthorized use of the 正字標記 after violating Article 11(3) or (4) can lead to a fine, and the fine may be imposed repeatedly until the person corrects the conduct.

標準專責機關在認為擅自使用正字標記的違法情事會損害或可能損害消費者生命、身體、健康或財產時，應公告違法者名稱、地址、商品或採取其他必要處置。

The competent authority is empowered to determine the implementing rules for this Act.

本法自公布日開始施行。

本條指定經濟部為本法主管機關，並要求其就標準事項設專責機關辦理；如事項涉及其他機關職掌，主管機關要會商相關機關處理。

國家標準原則上以自願方式實施；如果主管機關把全部或部分內容引用為法規，就依該法規規定。

標準專責機關設置國家標準審查委員會與各專門類別技術委員會，並負責審議國家標準相關事項。

National standards are to be handled through a listed procedure, and the competent authority is empowered to set the detailed procedures by regulation.

If relevant international standards or domestic group standards exist and fit Taiwan’s conditions, the standards authority may convert them into national standards.

在國家標準公布後五年內，如果沒有修訂建議，標準專責機關應予確認；已確認的國家標準也適用同樣規則。
