度量衡法

This Act is enacted to standardize weights and measures and ensure accurate measurement.

Legal measurement units are based on SI units, and the competent authority may designate common non-SI units as legal measurement units.

法定度量衡單位的倍數和分數，應以 10 及其正負乘方表示；其名稱、定義及代號由主管機關公告。

法定度量衡器應標示法定度量衡單位；但專供外銷、外銷產品配件、製造外銷產品工廠所需、製造工廠機器設備配件、學術研究試驗機構所需及國防所需者，不在此限。

使用度量衡單位進行交易或證明時，必須使用法定度量衡單位；相關推廣及輔導辦法由主管機關訂定。

度量衡專責機關可以對法定度量衡器進行檢定，並公告相關標示、構造、檢定公差、合格有效期間、最長使用期限及技術規範。

符合列舉情形的法定度量衡器，可以免檢定。

合格且使用中的法定度量衡器必須接受檢查；其所有人或持有人不得規避、妨礙或拒絕檢查。

Qualified statutory measuring instruments must have the qualification seal affixed separately.

主管機關有權訂定法定度量衡器檢定、檢查的種類、範圍、方式、時間，以及合格印證的式樣、附加與去除方法及相關管理事項辦法。

Certain approved legal measuring instruments must be re-applied for inspection after repair, adjustment, modification, or when their inspection validity period expires.

This article defines key metrology terms such as measuring units, measuring instruments, reference standards, legal metrology instruments, verification, inspection, calibration, traceability, type certification, and prepacked goods.

Verified legal measuring instruments may not be used for measurement, kept, sold, or displayed for sale if they have not passed verification, have not been re-verified as required, or their maximum service period has expired.

Certain verified legal measuring instruments may not be used or kept for measurement if they fail inspection, have an unreadable or detached verification seal without good reason, or have attached equipment that affects measuring function.

Certain regulated measuring instruments may be self-verified by an operator if listed by the competent authority, the operator meets the required conditions, and the specialized metrology authority approves it.

度量衡專責機關可不定期派員到業者廠場查核；受查核者不得規避、妨礙或拒絕。若查核不合規，機關應通知限期改正，逾期未改正則廢止許可。

交易當事人若因度量衡器準確度發生糾紛，可以向度量衡專責機關申請鑑定；相關鑑定辦法由主管機關訂定。

Certain legal measuring instruments must get type approval from the metrology authority before being manufactured in Taiwan or imported, and verification may only be done after approval.

度量衡專責機關可以認可指定實驗室，讓其辦理應經型式認證度量衡器的測試；相關資格、認可、證書有效期間、核發換發、撤銷廢止及管理事項，由主管機關訂定辦法。

經型式認證認可的法定度量衡器，應發給認可證書並公告；原申請人或其繼受人可在證書到期前六個月，向度量衡專責機關申請重新審查換發認可證書。

已取得型式認證的法定度量衡器，在認可有效期間內若相關準確度或穩定性規範修正，度量衡專責機關應通知原申請人或其繼受人限期改正。

If an approved legal metering instrument changes its approved content, an application must be made to the metrology authority for approval, series certification, or a new type-approval application.

經濟部是本法主管機關，並可指定專責機關辦理度量衡事務。

經型式認證認可後，原申請人的繼受人可以按原認可型式繼續製造或輸入該法定度量衡器。

If a certified legal metrology instrument was approved by fraud or made not in line with the approved type, the metrology authority must order the operator to stop sales and manufacturing and recall the instruments.

If a certified legal measuring instrument has one of the listed problems, the metrology authority must notify the operator to stop manufacturing and selling it and stop accepting inspections; until corrected, the instrument may not be inspected.

對已經型式認證認可的法定度量衡器，度量衡專責機關在符合列舉情形時可以廢止認可，並通知原申請人或其繼受人限期繳回認可證書。

Anyone manufacturing, repairing, or importing legal metrology instruments must get approval and a licence before starting business.

This provision is marked as deleted.

An application for a weights-and-measures business permit must be refused if either listed disqualifying condition applies.

度量衡業許可執照有效期間為十年，自發照日起算。期滿六個月前，可向度量衡專責機關申請重新審查換發。

經營法定度量衡器製造或修理的業者，應備置度量衡標準器，並按時送相關機關（構）追溯檢校。

Metrology businesses must apply to the competent metrology authority for inspection before a regulated measuring instrument leaves the factory or when it is imported.

度量衡專責機關可以設立國家度量衡標準實驗室，並可委託其他政府機關（構）或團體辦理其業務；該機關也負責訂定受委託者管理辦法。

If a metrology business has either of the listed problems, the metrology authority must revoke its permit and notify the business to return the permit license by a deadline; if it is not returned on time, the authority will publicly cancel it.

度量衡專責機關在特定違規情形下，應廢止度量衡業許可，並通知業者限期繳回許可執照；逾期不繳回的，機關可公告註銷。

度量衡專責機關可以派員稽查特定場所，並可要求場所負責人或度量衡業者提供資料、技術文件和樣品。

度量衡專責機關發現可能違法時，應立即調查；當事人或相關人員必須配合，不得規避、妨礙或拒絕。

度量衡專責機關可以自行或依消費者保護團體推薦，遴聘度量衡器義務監視員，協助監視並舉發違規度量衡器；相關遴聘、舉發程序及管理辦法由該機關會商相關機關訂定。

經指定公告的定量包裝商品，必須用法定度量衡單位標示淨含量，且標示量與實際量的誤差不得超出法定範圍。

度量衡專責機關可以不定期派員，到特定場所抽測定量包裝商品。

定量包裝商品的經銷商、生產者及輸入業者，對前條抽測應提供樣品並配合，不得規避、妨礙或拒絕。

指定公告的定量包裝商品如果抽測不合格，生產者或輸入業者可以申請一次複測，並要負擔複測費。

自行檢定的業者如果依第二十三條查核不符，會被處新臺幣二十萬元以上一百萬元以下罰鍰。

主管機關可以將與交易、證明、公務檢測、環境保護、公共安全或醫療衛生有關的度量衡器指定為法定度量衡器。

定量包裝商品的生產者或輸入者若未正確標示淨含量，經通知限期改正後仍未改正，或一年內抽測兩次不合格，將被處新臺幣10萬元至50萬元罰鍰。

Anyone who commits one of the listed measurement-law violations is subject to an NT$50,000 to NT$250,000 fine; instruments involved in item 1 are also confiscated and destroyed.

違反第20條，販賣或為販賣而陳列未經檢定合格、未重新申請檢定合格，或已逾最長使用期限的度量衡器者，會被處以新臺幣3萬元以上15萬元以下罰鍰。

If a person commits any of the listed violations, they are subject to a fine of NT$15,000 to NT$75,000.

If a person violates certain listed provisions and evades, obstructs, or refuses compliance, they are fined NT$10,000 to NT$50,000.

People who violate the Act may be fined, ordered to stop or correct the violation, and fined repeatedly if they still do not comply by the deadline.

依本法處以的罰鍰，若已限期繳納但到期仍未繳納，將依法移送強制執行。

Conducting personnel for investigations, inspections, audits, and sampling tests must show proof of their duties when lawfully performing public duties.

必要時，警察機關應派員協助度量衡專責機關執行本法。

Applicants for the listed metrology-business permits or approvals must pay the related fees, and the competent authority sets the charging standards.

主管機關可以委託其他政府機關（構）或團體，辦理法定度量衡器檢定、檢查及定量包裝商品抽測；相關受委託資格、評鑑、監督考核與管理辦法，由主管機關訂定。

主管機關負責訂定本法施行細則。

This law takes effect on the date it is promulgated. For the provisions amended on 2009-01-06, the effective date is set by the Executive Yuan.

辦理法定度量衡器檢定、檢查的機關、機構或團體，使用的度量衡標準器應適時追溯檢校；公務執行檢測用的度量衡器也同樣適用。

The responsible metrology authority may delegate related measurement management work to measurement experts, and before a separate law is enacted, the主管機關 may delegate the same work to measurement technical personnel.

在與他國、區域組織或國際組織簽有雙邊或多邊相互承認協定或協約時，度量衡專責機關可以承認依該協定或協約簽發的測試報告、檢定證明或相關證明。
