水患治理特別條例

This provision states that the law is enacted to speed up flood control and mountain flood protection in flood-prone areas, protect people’s lives and property, improve local living quality, and conserve the water environment.

地方主管機關或農田水利會要在中央執行機關指定期限內接管完工建造物，並在接管後逐年編列預算維護管理。

中央主管機關每年應向立法院報告執行情形及績效。

審計機關應依法對本條例所列預算的執行進行審計。

各機關（構）及農田水利會在辦理本條例下的治理計畫項目時，應依政府採購法相關規定辦理。

中央主管機關負責訂定第5條相關計畫書表格式及第6條推動小組設置與作業辦法，並報立法院備查。

計畫執行完畢後，依本條例編列之預算賸餘款，應依預算法規定繳回國庫，不得挪用。

This provision says the statute takes effect on the date it is published and lasts for eight years. It also says the amended provisions from 16 November 1999 took effect on 25 December 1999.

本條說明本條例的主管和執行機關，並列出各機關應辦事項及中央執行機關可委託地方政府或農田水利會執行工作。

This provision defines the ordinance’s scope and says the listed flood-control and related projects are not limited by specified provisions of the Local Government System Act. It also says land needed for certain river and drainage projects may be expropriated directly and is not limited by a specified provision of the Water Act.

中央政府為易淹水地區水患治理計畫編列特別預算，總上限為新臺幣1160億元，並有分期編列、部分資金籌措及例外適用規定。

中央主管機關要依流域整體治理及綜合治水原則，擬訂易淹水地區水患治理計畫；中央執行機關則依該計畫規劃各期執行計畫，送第六條推動小組審查後，再由中央主管機關核定為各期實施計畫。

中央主管機關應成立推動小組，辦理相關審查、督導、協調、研究與培訓工作；所需人力與經費由本條例支應。

This provision lets planning changes for flood-control projects in flood-prone areas be expedited when needed, and it allows regional planning authorities to review certain land-change applications together with related agencies.

直轄市、縣（市）政府應配合易淹水地區水患治理計畫需要，辦理市地重劃、區段徵收或農地重劃。

中央主管機關應將計畫書的重要內容及相關資訊報立法院備查，並公告於電信網路。
