鹽政條例

Salt management must follow the rules in this Act.

製鹽人必須在限定期間內，把所製的鹽全部繳存到鹽政機關指定的倉、坨或其他指定地點。

製鹽人在鹽存入倉或坨時，須配合鹽政機關進行品質檢定；不符合規定的，製鹽人應改製或銷燬。

製鹽人的售鹽價格原則上是場價；鹽政機關可以按種類，參照標準成本並酌加利潤來核定。

鹽在未經鹽政機關發給單照前，不得運銷；單照不得與鹽分離。

鹽之集散處所由鹽政機關指定；設在集散處所的鹽倉由鹽政機關管理。

鹽政機關可以分種類核定集散處所就倉發售的鹽價，也可以在考量產運需要時平衡前項倉價。

The salt administration authority coordinates and regulates the supply and distribution of salt.

鹽政機關可以因應地區需要，核定各類鹽的售價。

If one of the listed violations occurs, the salt may be confiscated and a fine imposed; very small quantities of 10 kg or less are exempt from the fine.

Anyone who sells fishery, industrial, or agricultural salt as table salt or food-processing salt is fined and must pay back the difference.

This provision defines “salt” to include salt, brine, salt ore, and mixtures containing at least 25% sodium chloride.

Anyone who violates Article 10 or sells salt above the approved salt price may be fined up to 3,000 yuan.

製鹽人如果繳鹽不足規定產額，要被處以等於短少鹽額當時場價的罰鍰；若因不可抗力或其他正當理由造成短產，則免罰。

銷鹽人或運鹽人不得在所銷或所運的食鹽或食品加工用鹽中摻入雜質；違者依食品衛生管理法處罰，且摻成的鹽由鹽政機關沒入處理。

鹽政機關要把本條例下的罰鍰和沒入移送法院裁定並執行；鹽政機關或受處分人不服裁定時，可在送達後10日內抗告，但不得再抗告。

本條例的施行細則由經濟部訂定。

本條例自公布日施行。

經濟部鹽政機關管理鹽的生產、製造、運輸和銷售。

Salt is divided into five categories based on its use.

This provision sets dry-basis quality standards for different kinds of salt, including minimum sodium chloride content, maximum impurities, and maximum moisture content.

鹽如果沒有經過經濟部許可，不得從國外輸入或對外輸出。

未經經濟部許可，不得採製或加工製造鹽。

經濟部可依全國產銷狀況核定產鹽區域及每年產鹽數量。

鹽政機關應在適當地點建設倉、坨供儲鹽使用；私人建造的倉、坨由鹽政機關管理，必要時也可以租用或收買。
