原子能法

This provision states the law’s purpose: to promote research and development of atomic energy science and technology, resource development, and peaceful use.

原子能委員會可以報請行政院，於相關科學研究機構設立原子能科學與技術研究發展部門。

Domestic scientific research institutions must cooperate, under the plan set by Article 7, in research on atomic energy science and its applications, so that researchers and equipment are used effectively.

國內大學及相關原子能科學研究機構，和友邦或國際相關組織簽訂研究合作協定時，應向原子能委員會申報核准。

原子能科學研究機構應補充放射性偵測、分析、化驗設備，並加強游離輻射防護研究；原子能委員會得指定該等研究機構辦理游離輻射防護訓練。

各科學研究機構得向原子能委員會申報，並可籌撥專款、延聘專家，以協助原子能科學與技術的研究發展。

Nuclear raw material mining and leasing rights are governed by the Mining Act, the exploration/storage/purchase/supervision rules must be strictly regulated, and the Executive Yuan sets the implementing rules.

原子能委員會得報請行政院核准，設立專門機構辦理核子原料及燃料的生產。

Certain imported nuclear research, development, production, protection, and nuclear power-related equipment should receive tariff reductions or exemptions, and the Executive Yuan will set the implementing rules.

核子原料的生產、輸入輸出、運送儲存、設施建造完成後的檢查，以及使用、廢棄、轉讓，都要依規定向原子能委員會申報或核准。

核子燃料的生產、輸入輸出、運送儲存、設施建造完成後、以及使用廢棄轉讓，都要依規定向原子能委員會申報或核准；未經核准不得輸入、輸出。

核子反應器的設置、建造、運轉、設計變更、執照移轉或轉讓，以及紀錄報送，都要先申報或取得原子能委員會核准；運轉與相關活動還須接受查驗、檢查或稽查。

原子能委員會應訂定防護游離輻射的安全標準，並報請行政院公布施行。

原子能委員會應會同內政部、國防部，就放射性落塵偵測訂定計劃、購置設備，並配發相關單位使用；偵檢紀錄由原子能委員會統一審定公布。

This provision requires licensing, reporting, inspections, and compliance rules for radioactive substances and ionizing-radiation equipment, with the Atomic Energy Commission overseeing approvals and checks.

Violating Article 28 by transferring a patent right without approval or making a nuclear science/technology cooperation contract with a foreign person is punishable by imprisonment, detention, or a fine.

If a person violates one of the listed provisions, they face imprisonment of up to one year, detention, or a fine of up to NT$3,000, and the nuclear materials or radioactive substances involved are confiscated.

The Executive Yuan prescribes the enforcement rules for this Act. The Atomic Energy Commission may collect necessary fees for implementing control under the Act, and the fee standards are set in those enforcement rules.

This provision says the Act takes effect on the date it is promulgated.

原子能委員會得為推進原子能研究發展、資源開發及應用，設立研究機構。

原子能委員會得為推廣原子能和平用途，報請行政院令有關部會設立原子能事業機構；私人設立原子能研究及事業機構時，須先經原子能委員會核准。

原子能委員會可以對外代表政府，處理國際合作事宜。

原子能委員會應籌措專款、延聘專家、訂定計劃，統籌推動原子能科學與技術的研究發展。

原子能委員會應輔導國內大學與研究所增設原子科學相關學系、充實設備，並發展原子科學教育。

原子能委員會應會同教育行政主管機關及國內各科學研究機構，統籌選送科學人才出國進修原子科學。
