低放射性廢棄物最終處置設施場址設置條例

This provision says the statute is enacted to select a site for a low-level radioactive waste final disposal facility and to meet safety and environmental protection requirements.

If a county/city government voluntarily wants to set up a disposal facility in its area, it must get approval, publish the plan, hold a hearing, and apply in writing within four months after the potential site is announced.

核定的候選場址公告期滿後30日内，由該場址所在地縣（市）辦理地方性公民投票；若同意，即得成為候選場址。

主辦機關得從核能發電後端營運基金提撥經費作為回饋金，用於推動處置設施選址；回饋金總額有上限，且分配比率與使用辦法由本條規定。

主辦機關 must 將環境影響說明書轉送環境保護主管機關備查，之後依規定進行第二階段環境影響評估。

選址作業者在候選場址通過環境影響評估後一個月內，須檢附相關資料並提報主辦機關；經行政院核定為處置設施場址後，還要在場址所在地公告。

選址作業者在處置設施場址需要公有土地時，應報請主辦機關依法辦理土地撥用；需要私有土地時，應報請主辦機關依法辦理土地徵收。

If land needed for a disposal facility involves an urban plan change, the main agency must coordinate with the urban planning authority to make the change quickly; if it involves non-urban land-use change, the main agency must coordinate with the regional planning authority to make the change.

Land expropriated under this provision must be put into use within six years after expropriation compensation has been fully paid. If it is not used on time, the original owner may apply to recover the land at the original compensation price, unless the delay was caused by a reason not attributable to the responsible agency.

Costs needed to select a disposal facility site are paid from the nuclear power backend operating fund, and property obtained with that money must be included in the fund.

主辦機關須會商主管機關，選定或指定選址作業者；選址作業者須提供資料、進行相關工作，並按季在主辦機關網站公開進度資料。

選址小組要在成立後六個月內擬訂處置設施選址計畫並送交主辦機關；主辦機關收到後十五日內要公告三十日，並在公告期滿兩個月內核定。

選址小組須在主辦機關核定選址計畫後六個月內，向主辦機關提報潛在場址公告。

選址小組要在公告後六個月內向主辦機關提出候選場址遴選報告，且至少建議兩個候選場址。主辦機關收到後十五日內要公開報告並在適當地點揭示三十日；期間內，機關、個人、法人或團體可書面提出意見。
