交通部郵電事業人員退休撫卹條例

交通部郵電事業人員的退休和撫卹，依本條例辦理；本條例沒有規定的事項，適用其他相關法律。

本條規定退休人員可依年資與退休類型領取一次退休金、月退休金，並列出部分不得兼領或不得發給月退休金的例外。

郵電事業人員退休時，原則上要填退休申請書，附上相關證件與領取退休金的印鑑，並由服務機構報請總機構或其授權機構核准；命令退休的人員可免填申請書。

退休金分為一次退休金與月退休金；一次退休金在退休離職當日發給，月退休金自次月起按月發給，直到權利喪失或停止的當月底。

退休郵電事業人員在特定情形下會喪失領取退休金的權利。

退休郵電事業人員在列明情況下會暫停領受月退休金的權利；原因消失後恢復。

郵電事業人員在特定死亡情形下，其遺族可領取撫卹金；因公死亡者可領一次及月撫卹金，因傷病死亡且任職滿一定年限者可領一次撫卹金。

This provision defines when a death is treated as “因公死亡” (death in the line of duty) and lists four qualifying situations.

符合條件的退休郵電事業人員死亡後，遺族可領月撫慰金或殮葬補助費；部分情形下，配偶還可終身領月撫慰金。

撫卹金或撫慰金的發給時間分為一次給付與按月給付兩種。

This provision sets the order of relatives who may receive survivor pension, consolation money, or funeral assistance, and limits some recipients by remarriage, age, capacity to earn a living, or proof of no support.

Eligible survivors in the same order share the benefit equally; if someone renounces or loses the right, the remaining eligible survivors in that order share it, or the next order if none remain. Renunciation must be in writing.

Certain heirs lose the right to receive survivor benefits or condolence payments if any listed disqualifying condition applies.

If a deceased person’s survivors fall into either listed category, their right to receive pension or consolation money is suspended until the cause ends.

遺族在列出的任一情形發生時，喪失月撫卹金或月撫慰金的領受權。

申請撫卹金或撫慰金時，申請人要填申請書並附死亡相關證件與受領印鑑；必要時也要附其他證明文件，並由服務機構報請核准。

When a survivor’s right to monthly pension or consolation payment ends, the person or another entitled person must file proof and the original certificate with the paying institution for cancellation or correction.

遺族如有喪失、停止或終止月撫卹金、月撫慰金領受權，應如實申報。

This provision sets the calculation base for pensions, survivor pensions, and consolation money at 78% of the salary level of in-service postal enterprise personnel at the same pay grade.

本條規定退休金、撫卹金、撫慰金或殮葬補助費的發給機關，並依機構裁併、裁撤或民營化時改由後續機構或中央主管機關發給。

郵電事業人員符合列出的任職年資時，可以合併計算。

請領退休金、撫卹金、撫慰金或殮葬補助費的權利，自可行使時起算，五年不行使就消滅；若因不可抗力不能行使，期間改自可行使時起算。

請領退休金、撫卹金、撫慰金或殮葬補助費的權利，不得拿去扣押、讓與或提供擔保。

郵電事業人員在職死亡時，遺族可領殮葬補助費，金額為六個基數。

交通部要另行訂定本條例施行前相關人員退休、撫卹、撫慰的條件與給與等規定；已依舊規定辦理的人，施行後仍適用原規定。

本條例自中華民國九十二年一月一日施行。

郵電事業人員的退休分為三種：自請退休、屆齡退休、命令退休。

郵電事業人員符合一定年資或年齡條件時，應准其自請退休；交通部也可對特殊危險或勞力職務者酌降第一款年齡，但不得低於50歲。

郵電事業人員年滿65歲應屆齡退休；特定危險或勞力職務的退休年齡可由交通部酌降，但不得低於55歲，且符合條件者可核准延長任職最長2年。

郵電事業人員在符合特定傷病或病假久未痊癒等情形時，應被命令退休。

服務機構在命令退休前，須有符合規定的醫院診斷證明；在特定情況下，也要先通知相關人員請病假治療，最後由服務機構主動辦理命令退休。

Certain retired personnel may apply for reemployment if they have recovered, are physically fit, can do the work, and have a hospital certificate; their original agency may also investigate and notify reemployment.
