船舶登記法

This provision says the term “ship” in this Act is defined according to the Ships Act.

在政府機關或自治團體因拍賣辦理所有權移轉登記時，登記權利人可憑該機關或自治團體證明登記原因的文件申請登記。

申請登記時，申請人要隨附列明的文件。

申請人提出申請書時，應載明列舉事項並由申請人簽名。

If the registration reason includes a special agreement, it must be stated in the application form.

當登記權利人有兩人以上時，申請書應載明各人的應有部分。

當登記原因沒有文件或無法提出文件時，申請人要在申請書內說明原因，附上保證書和申請書副本。

Multiple vessels that apply at the same time and have the same registration reason and purpose may use one application form.

If the registration obligor’s rights registration certificate is lost, the obligor must state the reason in the application and attach two guarantee letters with the application.

A registration application must be rejected if any listed defect exists, unless the applicant corrects it within the notice period.

主管機關完成登記後，應立即把登記證書發給申請人。

船舶登記由船籍港航政機關主管；但建造中船舶的抵押權登記，由建造地航政機關主管。

在由登記權利人單方申請登記時，主管機關完成登記後，應立即用登記通知書通知登記義務人。

主管機關在登記完成後，如發現登記有錯誤或遺漏，應儘速通知登記權利人及登記義務人。

在特定情況下，未能正式登記的人可以辦理暫時登記。

Temporary registration may be applied for by the registration right holder if they obtain the registration obligor’s consent document; if they cannot obtain it, they must state the reason and submit documents proving the basis for registration.

If a registrant’s name, title, residence, office, or native place changes, the registrant must submit proof documents and apply for an added notation registration with the application form.

When a rights-change registration affects a third party, the applicant must attach the third party’s written consent and apply for an annotation registration together with the application form.

申請更正登記且與第三人有利害關係時，適用前條規定。

主管機關受理設定抵押權、租賃權或權利變更申請時，除分別登記外，應在所有權登記證書上註明。

如果登記簿全部或部分滅失，主管機關要報請交通部訂出至少三個月的期限，並公告登記權利人申請回復登記。

申請前條的回復登記時，得由登記權利人檢具原登記證書提出申請。

Ships must be registered for the preservation, creation, transfer, change, restriction, disposal, or extinguishment of the listed rights.

If one ship has multiple registrations of the same kind of right, priority is determined by registration order unless another law provides otherwise.

Temporary registrations keep their original order for later formal registration, but they do not have registration effect before formal registration is completed.

Annotation registrations must follow the order of the main registration; among annotation registrations, the order follows the time they were registered.

初次申請登記所有權時，申請人應準備能證明自己是所有人的文件，但不必附送第十一條第二款、第三款及第五款所列文件。

首次申請船舶所有權登記時，申請人應隨申請書附送指定證書；若是本國建造且設有抵押權的船舶，還要附送登記抵押權證明文件。

申請所有權登記時，如果登記權利人的國籍有疑義，應提出書面聲明，並一併附送申請書。

When first applying for ownership registration, the application’s vessel-description field must list the vessel’s type, name, origin date if acquired abroad, hull material, tonnage, completion date, engine details, and propeller details. Non-powered vessels must still list items 1–6, and sailboats must also list the number of masts.

申請所有權登記時，如果登記權利人是法人，必須一併附送法人成立登記憑證或其影本與申請書。

船舶共有時，初次申請所有權登記的申請書要寫明各共有人的應有部分，以及船舶經理人的姓名、住所和居所；登記後如移轉部分所有權，適用同樣規定。

When certain ship registration details change, an application for notation registration must be filed with the ownership registration certificate; if the ship already has a registered mortgage or lease right, the registered right holder’s consent document must also be attached.

Matters that must be registered for a ship cannot be asserted against third parties unless they are registered.

主管機關在受理前條申請時，原則上應在所有權登記證書上註明；但附記登記不在此限。

If you apply to register after changing a ship’s registry port, you must attach a copy of the registration ledger issued by the competent authority of the former registry port, together with the application form.

船舶經理人變更登記應由原登記人提出申請。

船舶經理人變更姓名、住、居所或籍貫時，應附證明文件並自行申請登記。

申請抵押權設定登記時，申請書應記明債權數額；如有清償時期、利息、附帶條件或其他特約，也要一併記明。

申請因設定抵押權而辦理登記時，如果先前已經有抵押權登記，申請書應記明該已登記的抵押權。

申請抵押權設定登記時，如果設定人不是債務人，申請書必須載明債務人的姓名、年齡、籍貫、住所及居所。

When applying to register a mortgage, the application must state the estimated value of the secured claim if that claim is not a money claim.

申請以多艘船舶共同擔保債權登記時，申請人要另外提出共同擔保目錄，列明各船舶分擔的擔保部分並簽名。

申請抵押權移轉登記時，如果移轉是因部分債權讓與或代為清償，申請書必須記明該債額。

小船不適用本法的規定。

申請登記建造中船舶的抵押權時，申請書要載明指定事項，並向建造地航政主管機關提出；前五項還要附上造船者提供的證明文件。

申請租賃權設定登記時，申請書要記明租金及相關特約；若是轉租登記且轉租許可未登記，還要附上原出租人承諾字據。

If a vessel being built already has a registered mortgage and its home port is outside the mortgage registration authority’s jurisdiction, the application must include a copy of the mortgage registration and the mortgagee’s written undertaking.

If a transfer of ownership registration causes a co-ownership relationship to end, an application should be made to cancel the ship manager’s registration.

當出現列舉情形之一時，船舶所有權登記人應說明原因、附具證明文件，並申請註銷登記。

在特定前條情形且登記義務人死亡時，登記權利人應檢具死亡證明書申請註銷登記。

在登記義務人行蹤不明、無法共同申請註銷登記時，登記權利人可以向主管機關申請公告；公告期滿後，登記權利人可單獨申請註銷登記。

Temporary registration cancellation is to be applied for by the temporary registrant, and an interested party may also apply if they provide the registrant’s undertaking document or other proof.

If a cancellation registration affects a third party’s interests, the applicant must submit that third party’s consent document or other proof.

抵押權或租賃權依法消滅時，權利人要會同義務人向主管機關辦理註銷登記，並繳回登記證書；若是因法院裁判消滅，則可只由義務人申請註銷。

登記應由登記權利人、登記義務人或其代理人共同向主管機關申請；代理人申請時，還要提出本人簽名的授權書。

申請船舶登記時，原則上要按不同情形繳納登記費；公務船舶免繳。

申請移轉或註銷船籍港時，應按總噸數繳納登記費；轉籍每十噸二元，銷籍每十噸一元，不足十噸以十噸計。

申請登記簿影本或節本的人，應繳納抄錄費；如果是郵寄申請，還要繳納郵費。

申請閱覽登記簿或其附屬文件的人，應繳納閱覽費。

申請人或利害關係人，對登記處分如認為違法或不當，得依法提起訴願或行政訴訟。

交通部有權訂定本法的施行細則。

This law takes effect on the date it is published.

在判決確定或繼承遺產的登記情況下，申請人一方應備齊證明文件後提出申請。

當政府機關或自治團體是登記權利人時，登記權利人應取得登記義務人的承諾字據或其他證據後，再申請登記。

When a government agency or autonomous body is the registration obligor, the registration right-holder may apply for registration if they obtain a document from that body certifying the cause of registration.
