醫事人員人事條例

Medical personnel personnel matters are governed by this Act; if the Act does not cover a matter, other relevant laws apply.

醫事人員的俸給分為本俸、年功俸和加給，並按月計算。

This provision sets how medical personnel salary grades are initially determined, with special starting points for higher professional certificates and prior grade determinations.

醫事人員符合條件的前職年資，原則上可依規定按年折算加級；但若已核敘較高俸級，較低俸級部分的年資不得重複加級，除非是自最低俸級起敘的情形。

醫事人員的考績獎懲，除本俸、年功俸晉級按醫事職務級別辦理外，其餘事項適用公務人員考績法。

醫事人員可以兼任公立醫療機構的首長、副首長或醫事單位主管、副主管；這些職務的任期和遴用資格由各主管機關會商中央衛生主管機關後決定。

依本條例任用的醫事人員，除非已通過公務人員考試或另有其他法律規定的任用資格，否則不得轉調到非由醫事人員擔任的職務。

本條規定：本條例施行前依其他法律任用的現職醫事人員，若符合第4條任用資格，依其原銓敘資格改任換敘；不符合者，仍適用原有法律並任用到離職為止。

本條例施行後，符合新制定醫事專業法律適用本條例的現職醫事人員，依前條規定辦理。

符合條件的離職人員再任醫事人員時，得依第十六條辦理改任換敘；若原職等俸級高於新職務俸級範圍，則改按該職務最高年功俸辦理，超過部分保留，日後調任相當職務級別時再恢復。

本條例施行細則由銓敘部會同中央衛生主管機關定之。

This article defines “medical personnel” and says the Examination Yuan, together with the Executive Yuan, determines the list of positions covered by the Act for each agency.

本條例的施行日期由考試院會同行政院決定。

Government agencies must include medical position quotas and grades in their organization rules or staffing tables, based on job responsibility and required professional expertise. The Examination Yuan and Executive Yuan set the allocation standards for teacher-grade medical posts.

符合列明條件的人，得依其所持醫事專門職業證書，取得相應類別醫事人員任用資格。

各機關遴用新進醫事人員時，原則上要依外補程序，以公開競爭方式從具任用資格的人員中甄選，但有三類人員例外。

Medical personnel appointed to any level of position must first serve a six-month probation, unless they have at least six months’ experience in a similar or one-level-lower position in a qualifying institution. Probationers may not also serve in supervisory positions.

符合特定學歷、經歷、專業訓練與年資條件者，可取得醫事職務師（二）級或（一）級醫事人員任用資格。

醫事人員在依法先行代理後，應送請銓敘部審定；審定不合格的，應立即停止代理。

公立醫療機構聘用住院醫師，須依聘用人員進用的法律規定辦理；本條例施行前已銓敘且仍在職的住院醫師，得繼續任用到離職為止。
