解剖屍體條例

因學術研究需要而要解剖屍體的人，應依本條例辦理。

本條例自公布日開始施行。

Public or registered private medical schools may perform cadaver dissection, and certain listed medical schools, hospitals, or institutions may conduct cadaver pathological autopsies if led by a physician engaged in pathology research.

This provision limits which bodies may be used for dissection or pathology exam and sets notice, waiting, and consent rules.

收領屍體後，原則上要立刻填具報告書並報告檢察官；送達後六小時內不得做防腐處置或解剖，但檢察官可在六小時內用書面禁止。

大體解剖及病理剖驗的屍體，可以保留部分屍體供學術研究；病理剖驗時，未經親屬同意，不得毀損屍體外形，但特定情形除外。

If a dissected body is found to have died from a statutory infectious disease, homicide, suicide, manslaughter, or a disaster, the case must be reported to the competent authority within 24 hours.

從事大體解剖或病理剖驗的醫學院、醫院或機構，必須建立簿冊並記載指定事項；如果第二款事項無法查明，要填寫「未詳」。

If an autopsied body is unclaimed by relatives, the medical school, hospital, or institution that performed the autopsy must arrange burial and marking.

執行解剖的醫學院、醫院或機構，應在每年一月底前，依第七條簿冊所載事項，將上年度解剖屍體的情形造冊報送衛生機關，再轉報中央衛生主管機關備查。
