促進醫療服務業發展條例

This provision states that the act is enacted to promote the development of the medical services industry, strengthen the domestic healthcare system, and improve medical service quality.

行政院在整體評估後，決定本條例的施行年限以及是否繼續施行。

本條例自公布日起施行。

This provision says the statute applies to medical services development, and where it does not cover an issue, other related laws apply; if another law is more favorable, the more favorable law applies.

本條例的主管機關是行政院衛生署；醫療服務業的定義由主管機關決定。

醫療服務業購買特定研究、實驗、檢驗、節能或防治污染設備時，可以按二年加速折舊。

法人醫療機構可以就特定醫療投資與研發、培訓支出，按一定比例抵減當年度營利事業所得稅，未抵完的可往後四年繼續抵減。

法人醫療機構在特定地區投資設立醫療機構並符合條件時，可按投資金額一定比例抵減當年度營利事業所得稅；主管機關並應提供優先使用釋出農地的優惠。

行政院應設置醫療服務業開發基金，並由行政院訂定該基金的管理及運用辦法。

政府應捐助成立技術輔導單位，提供醫療技術輔導；相關輔導辦法由行政院訂定。

與醫療發展有關的投資事業，應予輔導協助；其範圍與輔導方式由行政院決定。
