安寧緩和醫療條例

This provision states that the law is made to respect the medical wishes of terminally ill patients and protect their rights.

If a physician violates Article 7, they face a fine of NT$60,000 to NT$300,000 and may also be suspended for 1 month to 1 year or have their practice license revoked.

A physician who violates Article 9 is subject to a fine of NT$30,000 to NT$150,000.

The municipal or county/city competent authority imposes the fines, business suspension, and practice-license revocation covered by this provision.

中央主管機關負責訂定本條例的施行細則。

This provision says the条例 takes effect on the date it is published.

This provision says which authority counts as the competent authority, depending on level of government.

This provision defines six terms used in the article, including palliative care, terminal patient, CPR, life-sustaining treatment, life-sustaining treatment choices, and the person making an advance directive.

末期病人可以立意願書，選擇安寧緩和醫療或維生醫療抉擇。

成年且具行為能力的人可以預立第四條的意願書，並可預立醫療委任代理人。

意願人可以隨時自行或委由代理人，以書面撤回其意願表示。

同意後，中央主管機關要把意願註記到健保卡；撤回意願時要通報廢止註記。

要不施行心肺復甦術或維生醫療，需符合醫師診斷、意願書或替代同意文件等條件。

醫師應向末期病人或其家屬告知病情、安寧緩和醫療的治療方針及維生醫療抉擇；若病人明確表示想知道病情及各種醫療選項，也應告知。

醫師必須將第4條至前條規定事項詳細記載於病歷，且意願書或同意書要連同病歷保存。
