心理師法

A Republic of China national who passes the clinical psychologist exam and holds the required certificate may serve as a clinical psychologist; the same rule applies to counseling psychologists.

心理師執業原則上以一處為限，並應在核准登記或認可的特定機構內執業。

心理師歇業或停業時，須在事實發生後30日內報請原發執業執照機關備查；變更執業處所或復業時，準用第七條關於執業的規定；心理師死亡時，由原發執業執照機關註銷執業執照。

心理師執業時，應加入所在地的臨床心理師或諮商心理師公會；公會不得拒絕具有會員資格的人入會。

臨床心理師的業務範圍包括多種心理衡鑑、諮商與治療；其中第六款和第七款業務須依醫師開具的診斷、照會或醫囑辦理。

諮商心理師可以從事本條列出的諮商心理業務；其中精神官能症的心理諮商與治療，須依醫師的診斷、照會或醫囑進行。

心理師執行業務時，應製作紀錄，並記載指定的個案資料、業務情形與日期，以及其他依法應記載事項。

心理師執行業務時，若發現個案當事人疑似有特定精神或腦部心智功能疾病，應予轉診。

心理師或其執業機構人員，不得無故洩漏因業務知悉或持有的個案秘密。

心理師在執行業務時，不得施行手術、電療、使用藥品或其他醫療行為。

心理師執行業務時，必須尊重個案文化背景，不得因特定身分差異而差別待遇，並且要先取得同意、告知應有權益。

People who meet the specified education, internship, and degree requirements may take the clinical psychologist or counseling psychologist exam.

臨床心理師和諮商心理師可以設立各自的機構，但申請設立前要先完成臨床實務訓練並取得證明文件，且要向所在地主管機關申請核准登記。

心理治療所或心理諮商所要由申請人擔任負責心理師，負責心理師也要督導機構業務。

心理治療所或心理諮商所要使用或變更名稱，須先取得原發開業執照所在地主管機關核准；不是這類機構的，不能使用這些或相似名稱。

心理治療所或心理諮商所歇業、停業、變更登記事項、遷移或復業時，須依本條向原發開業執照機關辦理備查、核准變更登記，並準用設立的相關規定。

心理治療所或心理諮商所必須在明顯處揭示開業執照、收費標準，以及所屬臨床心理師和諮商心理師的證書。

心理治療所或心理諮商所必須妥善保管執行業務紀錄及醫師開具的診斷、照會或醫囑，且至少保存10年。

心理治療所或心理諮商所收費時，必須開給收費明細表和收據，且不得超額或自訂名目違反收費標準。

心理治療所和心理諮商所的廣告內容只能包含法定項目；其他機構不得刊登心理治療或心理諮商廣告。

心理治療所、心理諮商所、心理師及其執業機構人員，不得用不正當方法招攬業務，也不得利用業務機會取得不正當利益。

心理治療所或心理諮商所須依規定或主管機關通知提出報告，並接受主管機關對其人員、設備、衛生、安全、收費情形及作業等的檢查和資料蒐集。

This provision defines the competent authority: the Ministry of Health and Welfare at the central level, the municipal government in a special municipality, and the county/city government in a county or city.

經主管機關依第十條認可、且設有臨床心理或諮商心理單位或部門的機構，適用本章規定。

違反列舉條文者，會被罰鍰；部分情況還要限期改善，逾期未改善可被停業或按日連續處罰。

心理師在停業處分後仍執行業務的，會被廢止執業執照；在執業執照已被廢止後仍執行業務的，會被廢止臨床心理師證書或諮商心理師證書。

Psychological treatment or counseling centers may have their operating license revoked if they let unqualified people perform psychologist work or if they keep operating after being ordered suspended.

Violations of the listed articles or standards can lead to an NT$10,000 to NT$50,000 fine, and some cases also require correction by a deadline; if not corrected, business suspension of 1 month to 1 year may follow.

違反指定條文者，會被處以罰鍰；若違反第26條第1、2項或第28條第1項，還可能被命限期改善或退還超收款，逾期未改善或退還者，另可處停業或廢止開業執照。

A person who violates the listed provisions is subject to an administrative fine of NT$30,000 to NT$150,000.

If a psychologist violates certain listed provisions and is punished under Article 31 or the preceding article, the psychologist’s practice institution is also fined the same amount; if another law has a different penalty rule, that law controls.

If a psychological treatment center or counseling center is suspended or has its operating license revoked, the responsible psychologist must also be suspended or have their practice license revoked. The reverse also applies.

If a psychological therapy or counseling institution keeps operating after its practice license has been revoked, the responsible psychologist’s clinical psychologist or counseling psychologist certificate must be revoked.

申請臨床心理師或諮商心理師證書時，應檢附申請書與資格證明文件，並送中央主管機關核發。

心理師如果把自己的證照租借給他人使用，可能會被廢止臨床心理師證書或諮商心理師證書。

心理師在業務上有違法或不正當行為時，除本法另有規定外，會被處以新臺幣2萬至10萬元罰鍰；情節重大者，還可能被停業1個月以上1年以下，或被廢止執業執照。

未具臨床心理師或諮商心理師資格者，不得擅自執行相關業務；違者可處二年以下有期徒刑，並得併科罰金。

Clinical psychologists, counseling psychologists, and psychologists who violate the cited provisions are subject to imprisonment and possible additional fines.

在心理治療所或心理諮商所，與本法所定罰鍰相關的處罰對象是負責心理師。

This provision assigns authority to impose certain fines, business suspensions, and license revocations to local competent authorities, unless the law provides otherwise, and assigns revocation or cancellation of certain psychologist certificates to the central competent authority.

If a fine is not paid by the deadline, it is referred for compulsory enforcement under the law.

臨床心理師公會或諮商心理師公會的主管機關是人民團體主管機關；其目的事業應受主管機關指導、監督。

臨床心理師公會或諮商心理師公會可設全國聯合會，且其會址原則上應設在各該主管機關所在地區。

臨床心理師公會或諮商心理師公會的區域，依現有行政區域劃分；同一區域內同級公會以一個為限。

沒有臨床心理師或諮商心理師證書的人，不得使用這兩種名稱。

直轄市、縣（市）的臨床心理師公會或諮商心理師公會，須由轄區內各有九人以上的臨床心理師或諮商心理師發起組織；未滿九人的，可以加入鄰近區域的公會。

臨床心理師公會或諮商心理師公會全國聯合會，須在至少三分之一以上的直轄市、縣（市）相關公會完成組織後，才可以發起設立。

這條規定臨床心理師公會或諮商心理師公會的理監事名額上限，以及理事長、監事會召集人的選舉方式。

理事和監事的任期都是三年；連選連任的人不得超過二分之一，理事長連任以一次為限。

全國聯合會的理監事當選資格，不限於各直轄市、縣（市）公會派出的會員代表；各公會派往全國聯合會的會員代表，也不限於其理監事。

臨床心理師公會或諮商心理師公會每年要召開一次會員（會員代表）大會；必要時，可以召集臨時大會。

臨床心理師公會或諮商心理師公會必須訂立章程，編製會員名冊和選任職員簡歷冊，並向所在地人民團體主管機關申請立案，同時分送中央及直轄市、縣（市）主管機關備查。

各級臨床心理師公會及諮商心理師公會的章程，必須列明法條所列各項內容。

地方臨床心理師公會或諮商心理師公會必須遵守全國聯合會的章程、專業倫理規範和決議；如有違反，人民團體主管機關可作成警告、撤銷決議、撤免理事監事或限期整理等處分。

公會會員若違反法令、章程或專業倫理規範，公會得依章程及相關決議予以處分。

有特定情形者，不得擔任臨床心理師或諮商心理師；若已擔任，證書將被撤銷或廢止。

Foreigners may take the clinical or counseling psychologist exam, but if they pass and hold the certificate, they must get central authority permission before practicing in Taiwan and follow the related rules.

Some qualified people may sit the special exams for clinical psychologist or counseling psychologist if the central competent authority approves them.

主管機關核發證書或執照時，可以收取證書費或執照費；費額由中央主管機關訂定。

中央主管機關負責訂定本法施行細則。

This provision says the law takes effect on the date it is promulgated.

Psychotherapists must register with the local competent authority where they practice and hold a practice license before practicing. They must also first practice at a central-authority-designated institution and complete at least two years of clinical practical training.

心理師執業時必須接受繼續教育，並且每六年提出完成繼續教育的證明文件，辦理執業執照更新。

在三種情形下，不得發給執業執照；如果已經領到，也會被撤銷或廢止。
