語言治療師法

符合考試及證書條件的中華民國國民，可以擔任語言治療師。

語言治療師停業或歇業時，須在事實發生後30日內向原發執業執照機關報備；停業最長1年，超過1年應辦理歇業。

語言治療師執業時，應加入所在地的語言治療師公會；公會不得拒絕有會員資格的人入會。

This provision lists what speech therapists may do and says those services must be performed after a doctor’s diagnosis and in line with the doctor’s referral or order.

語言治療師執行業務時，必須親自製作紀錄，簽名或蓋章並註明執行日期，且要列明指定事項；前項紀錄還要連同個案基本資料保存。

語言治療師在受有關機關詢問或委託鑑定時，不得作虛偽陳述或報告。

語言治療師或其執業機構人員，不得無故洩漏因業務知悉或持有的個案秘密。

語言治療所開業要先向所在地直轄市或縣（市）主管機關申請核准登記；營利法人不得申請設立語言治療所。

語言治療所必須設置負責語言治療師；該負責語言治療師要負責督導機構業務，且人選限於在中央主管機關指定機構執行業務二年以上者。

語言治療所負責語言治療師不能執行業務時，應指定符合前條資格的人代理；若代理超過45日，還要由被代理者向原發開業執照機關備查，且代理最長不得超過1年。

語言治療所要使用或變更名稱，必須先經所在地直轄市、縣（市）主管機關核准；非語言治療所不得使用「語言治療所」或類似名稱。

符合指定學校與科系、主修語言治療，並完成至少六個月或三百七十五小時實習且成績及格、持有畢業證書者，得參加語言治療師考試。

語言治療所停業、歇業或登記事項變更時，須在30日內向原發開業執照機關報請備查或核准；停業最長1年，逾1年應辦理歇業。

語言治療所必須在明顯處揭示其開業執照和收費標準。

語言治療所的業務紀錄、醫師照會單或醫囑單，應妥善保管，至少保存 7 年；如果個案是未成年人，則要保存到其成年後再滿 7 年。

語言治療所的醫療費用收費標準由直轄市、縣（市）主管機關核定；收費時應開立載明項目與金額的收據，且不得違反收費標準超收或另設收費項目。

語言治療所做廣告時，內容只能包含法定列舉事項；非語言治療所不得刊登語言治療廣告。

語言治療所不得用不正當方法招攬業務；語言治療師及其執業機構之人員不得利用業務機會獲取不正當利益。

語言治療所須依法律規定或主管機關通知提出報告，並接受主管機關就人員、設備、衛生、安全、收費及作業等事項的檢查與資料蒐集。

經中央主管機關依第九條認可、且設有語言治療單位或部門的機構，適用本章規定。

語言治療師把自己的證照租借給他人使用時，會被廢止語言治療師證書；若同時涉及刑事責任，案件並應移送該管檢察機關依法處理。

Language therapy clinics must not let unqualified people perform speech therapist work; if they do, the clinic’s business license is revoked.

This provision defines which authorities count as the competent authority: the central authority is the Ministry of Health and Welfare, in a special municipality it is the municipal government, and in a county or city it is the county/city government.

Anyone who violates the listed provisions may be fined between NT$30,000 and NT$150,000.

未取得語言治療師資格者，不得擅自執行語言治療師業務；例外情形外，違者本人及其雇主各罰新臺幣3萬至15萬元。

Violating the listed provisions can lead to a NT$20,000 to NT$100,000 fine.

Speech therapists who commit any listed violation may be fined NT$20,000 to NT$100,000; serious cases may also face suspension or revocation of the practice license, and criminal matters are referred to the competent prosecutor.

語言治療師或語言治療師公會違規時，會被處罰鍰，並可能被命令限期改善；逾期未改善還會有停業處分或按日連續處罰。

語言治療所違反指定規定或設置標準不符時，會被處新臺幣一萬元以上五萬元以下罰鍰，並命限期改善；逾期未改善，還可能被停業一個月以上一年以下。

A speech therapist or a speech therapy clinic that violates the referenced provisions is subject to a fine.

If a speech therapist breaches one of the listed provisions and is punished under Article 34 or 30, the therapist’s practice institution is also fined under the same article. Other laws with different penalty rules prevail.

If a language therapist keeps practicing while under suspension, the practice license is revoked; if they keep practicing after their license has been revoked, the language therapist certificate is revoked.

A language therapy institution that keeps operating after a suspension order has its practice license revoked. If it keeps operating after revocation of that license, the responsible language therapist’s certificate is revoked.

申請領取語言治療師證書的人，必須檢附申請書和資格證明文件，送中央主管機關核發。

語言治療所和其負責語言治療師之間有連動處分：一方被停業或撤照時，另一方也要同時被停業或撤照。

If a speech therapist applies to establish a speech therapy clinic, the responsible speech therapist is subject to the fines provided by this Act.

直轄市、縣（市）主管機關負責作成本法所定的罰鍰、停業、廢止執業執照或開業執照處分；中央主管機關負責撤銷或廢止語言治療師證書。

語言治療師公會由人民團體主管機關主管，且其目的事業應受主管機關指導與監督。

語言治療師公會可設立全國聯合會；同時，公會分為直轄市及縣（市）公會。

Language therapist associations are organized by existing administrative regions, and only one association of the same level is allowed in each region.

直轄市、縣（市）語言治療師公會，應由該區域內九人以上的語言治療師作為發起組織；未滿九人的，得加入鄰近區域的公會或共同組織。

語言治療師公會全國聯合會要發起組織，須先有三分之一以上的直轄市、縣（市）語言治療師公會完成組織。

語言治療師公會的理監事由會員（會員代表）在會員大會中選舉，並有理事、監事、候補理監事及常務職務的人數上限。

理事、監事的任期都是三年；其連選連任的人數不得超過二分之一；理事長連任最多一次。

未領有語言治療師證書的人，不得使用「語言治療師」的名稱。

The election of the national federation’s directors and supervisors is not limited to member representatives selected by local speech therapist associations, and those local-association representatives are not limited to serving as directors or supervisors.

語言治療師公會每年應召開一次會員（會員代表）大會；必要時也可以召集臨時大會。

Language therapists’ association must set its bylaws, prepare membership and officer lists, apply for registration with the local competent authority, and send the materials to the central and local authorities for filing.

各級語言治療師公會的章程必須載明指定事項。

直轄市、縣（市）語言治療師公會必須遵守語言治療師公會全國聯合會的章程和決議。

If a language therapy association violates the law or its charter, the competent authority for people’s organizations may issue warnings, revoke resolutions, remove directors or supervisors, or order rectification within a deadline.

語言治療師公會可依章程或相關會議決議，處分有違反法令或章程行為的會員。

外國人得依中華民國法律應語言治療師考試；若考試及格並領有證書，於中華民國執業前須先申請許可，且要遵守相關法令、專業倫理與公會章程。

符合條件的人可以應語言治療師特種考試；中央主管機關負責審查，並有五年內舉辦五次的時程限制。

主管機關在依本法核發證書或執照時，可以收取證書費或執照費；收費標準由中央主管機關訂定。

If a person has previously been subject to revocation of a language therapist certificate under this Act, they may not act as a language therapist.

中央主管機關負責訂定本法施行細則。

This law takes effect on the date it is promulgated.

語言治療師執業前，須先向執業所在地主管機關申請執業登記並取得執業執照；執業後也須接受繼續教育，且每六年完成一定時數，才能更新執業執照。

在列舉情形之一時，不得發給執業執照；已領照者，會被撤銷或廢止。第三款所述不能執行業務的原因消失後，仍可依本法重新申請執業執照。

語言治療師執業原則上只能在一處進行，且應在核准登記或中央認可公告的機構執業。
