漢生病病患人權保障及補償條例

This provision states that the law is enacted to provide comfort and compensation to Hansen's disease patients harmed by social exclusion from isolation treatment policies, and to protect their medical and convalescent rights.

符合條件的漢生病死亡者，其配偶或直系血親卑親屬可領一次撫慰金新臺幣二十萬元。

People receiving compensation or consolation money under this Act are exempt from income tax.

主管機關應依預算程序辦理本條例所需經費。

The regulation takes effect from the date it is promulgated.

本條把「漢生病病患」定義為相關法令所規定的痲瘋（癩）病病人及康復者；並要求各主管機關在本條例施行日起六個月內，依本條例修正相關法令。

本條例的主管機關是中央衛生主管機關。

符合條件的漢生病相關存活者，依住院期間長短發給補償金；另有誤遭強制隔離者的補償標準。

申請補償金的人必須用書面提出申請，並載明指定事項、檢附相關證明文件；若同時申請前條所述兩種補償金，還要加載療養機構名稱、地址與入住期間。

主管機關收到申請後，應在3個月內完成審查並通知申請人；符合補償資格者，應在通知送達後2個月內一次發給補償金，但逾2年未領取者，不予發給。

政府應在樂生療養院內適當範圍規劃漢生醫療園區。

補償金請求權不得讓與、繼承、扣押或供擔保。
