藥事法

Pharmaceutical matters are governed by this Act; if this Act does not cover an issue, other related laws apply, and controlled-drug rules take priority when they exist.

This provision defines “固有成方製劑” as a formula prepared from traditional Chinese medicine prescriptions selected and announced by the central health authority as having medical efficacy.

除另有規定外，本法所定的罰鍰由直轄市、縣（市）衛生主管機關處罰。

新藥藥品許可證所有人應依相關規定提報專利資訊；若以詐欺或虛偽不實方式提報且涉及刑事責任，將移送司法機關辦理。

If a person punishable under this Act is suspected of a crime, they must be referred to the judicial authority for handling.

醫師在符合條件時，可以依自己開的處方親自調劑藥品；但這項規定在全民健康保險實施二年後，僅限於公告無藥事人員執業的偏遠地區或醫療急迫情形。

符合特定過渡條件的中藥販賣業者及中藥從業人員，可以繼續經營中藥販賣業務；部分人員在再受訓、取得證明並通過考試後，業務範圍可包括更多項目。

符合條件的西藥販賣業者或西藥種商所聘請、專任管理的藥師或藥劑生，免受第二十八條第一項駐店管理限制。

This provision defines which western medicine sellers/traders are covered: those approved and licensed before 1978-12-31, whose person-in-charge has not changed since 1979-01-01 and who are still operating, with one retail-business exception.

申請證照、事項或相關函詢時，應繳納費用；費用種類與金額由中央衛生主管機關決定。

各級衛生主管機關在必要時，可以把藥物抽查及檢驗的一部分或全部，委任所屬機關或委託相關機關（構）辦理；相關委任、委託及事項辦法由中央衛生主管機關訂定。

中央衛生主管機關可以辦理藥物檢驗相關檢驗機構的認證，並訂定認證、管理及委任委託辦法。

中央衛生主管機關負責訂定本法施行細則。

本法原則上自公布日施行；另有特定修正條文自指定日期施行，部分條文的施行日期由行政院決定。

This provision defines “controlled drugs” as the controlled drugs referred to in Article 3 of the Controlled Drugs Management Act.

本條定義「毒劇藥品」為中華藥典毒劇藥表所列的藥品；未列入表中的，由中央衛生主管機關決定。

藥品製造業者若要輸入自用原料，必須每次進口前先向中央衛生主管機關申請核准；已進口的自用原料，未經核准不得轉售或轉讓。

This provision defines who counts as a medical device seller and says medical device leasing operators are subject to the same rules as medical device sellers.

醫療器材製造業者是指製造、裝配醫療器材，並從事其產品批發、輸出及自用原料輸入的業者；這類業者也可以兼營自製產品零售。

This provision defines what counts as a pharmacy, allows a pharmacy to also sell medicines and certain medical devices, and lets the central health authority set the scope and types of those medical devices.

This provision defines “衛生主管機關” and says it means the Ministry of Health and Welfare at the central level, a municipal government at the special municipality level, and a county/city government at the county/city level.

This provision defines when a drug is treated as a fake drug.

This provision defines when an approved medicine is treated as “劣藥” (substandard drug).

本條定義「禁藥」：凡屬主管機關公告禁止相關活動的毒害藥品，或未經核准擅自輸入的藥品，都屬禁藥；但旅客或交通工具服務人員攜帶自用藥品進口不在此限。

This provision defines when a medical device is treated as “unfit/defective” under the law.

“Drug advertisement” means using communication methods to promote medical efficacy for the purpose of attracting sales.

This provision defines “label” as a marking on the container or packaging of a drug or medical device that records text, pictures, or symbols.

“仿單” means the explanatory leaflet attached to drugs or medical devices.

申請成為藥商的人，必須先向直轄市或縣（市）衛生主管機關辦理核准登記、繳納執照費，取得許可執照後才能營業；登記事項變更時要辦理變更登記。

藥商申請停業、歇業或復業時，須依規定繳交或繳銷相關證照，且停業期間每次不得超過一年。

持有必要藥品許可證的藥商，必須定期向中央衛生主管機關申報製造、輸入和供應情形；若可能無法繼續製造、輸入或供應，原則上要至少提前六個月通報，天災等不可歸責情形則改為事實發生後30日內通報。

中央衛生主管機關在知道有藥品可能供應不足時，可以把情形登錄到公開網站，並可專案核准該藥品或替代藥品的製造或輸入。

西藥販賣業者原則上應由專任藥師駐店管理；若不售賣麻醉藥品，可由專任藥劑生管理。中藥販賣業者則應由專任中醫師，或符合中藥課程標準的藥師或藥劑生駐店管理。

西藥製造業者須由專任藥師駐廠監製；中藥製造業者須由專任中醫師或符合課程標準的藥師駐廠監製。

中央衛生主管機關可以設置藥物管理機關；直轄市與縣（市）衛生主管機關在必要時也可以報准後設置。

藥商聘用的藥師、藥劑生或中醫師若被解聘或辭聘，藥商應立即另聘。

從事人用生物藥品製造的業者，必須聘用符合特定學歷、專業知識與五年以上製造經驗的技術人員駐廠負責製造。

醫療器材販賣或製造業者要依其類別聘用技術人員；醫療器材類別與技術人員資格由中央衛生主管機關訂定。

藥商僱用的推銷員，先由業者向當地衛生主管機關登記後，才可以執行推銷工作。

藥局必須請領藥局執照，並在明顯處標示經營者的身分姓名。

A pharmacist who has completed Chinese medicine training to the required standard may run a pharmacy that personally manages the business of dispensing, supplying, or retailing Chinese medicine.

A pharmacist-managed pharmacy with appraisal equipment may carry out drug appraisal work.

藥品調劑一般要依作業程序進行，並由藥師處理；不含麻醉藥品者，藥劑生也可以做。

When a 藥劑生 dispenses medicines, the rules in the Pharmacists Act articles 12 and 16 to 20 apply with necessary changes.

製造或輸入藥品前，原則上要向中央衛生主管機關申請查驗登記、備齊資料並繳費；核准發給藥品許可證後，才能製造或輸入。

This provision defines “drug” to include pharmaceuticals and medical devices.

製造或輸入醫療器材前，先向中央衛生主管機關申請查驗登記並繳費；核准發證後才可以製造或輸入。

中央衛生主管機關在為維護公益且有必要時，可以公開其持有並保管的相關藥物資料；但藥商申請新藥查驗登記中的營業秘密資料，應予保密。

主管機關核發新藥許可證時，應公開申請人附上的已揭露專利字號或案號；新成分新藥核發後三年內，其他藥商未經許可證所有人同意不得引用其申請資料申請查驗登記。

新適應症或變更適應症核准後，其他藥商在一定期間內不得未經許可證所有人同意引用該申請資料申請同一適應症查驗登記；之後可申請，但主管機關發證時間仍受三年或五年的限制。

中央衛生主管機關每年應委託專業醫療團體辦理教育訓練，以培育臨床試驗人才；也得會同中央工業主管機關獎勵新興藥物科技研究發展。

中央衛生主管機關應訂定作業準則，作為製造、輸入藥物之許可證核發、變更及展延基準。

中央衛生主管機關決定製造、輸入藥物的查驗登記申請書，以及輸出藥物申請書的格式、樣品份數、相關資料，並可決定證書費與查驗費金額。

試驗用藥物在供經核可的教學醫院進行臨床試驗前，必須先取得中央衛生主管機關核准。

中央衛生主管機關可以指定期間，對經核准製造或輸入的藥物進行安全性監視；藥商在該期間內要遵守主管機關訂定的事項。

醫療機構、藥局及藥商，對於藥物引起的嚴重不良反應，應予通報。

經核准製造或輸入的藥物，變更原登記事項前必須先取得中央衛生主管機關核准；若藥物許可證發生移轉，則應辦理移轉登記。

藥物製造或輸入許可證有效期為5年；到期後若要繼續製造或輸入，須事先向中央衛生主管機關申請展延，且每次展延不得超過5年。

If a drug is found to have safety or efficacy concerns during the validity of its manufacturing or import permit, the central health authority may order the drug business operator to fix the issue within a time limit; if it is not fixed by then, the permit may be revoked, and major safety concerns may allow immediate revocation.

製造或輸入藥品的人，必須先標示中文標籤、仿單或包裝，才能買賣、批發或零售；但中央衛生主管機關認定有窒礙難行者，不在此限。

If a generic drug license application only concerns the declarations in item 1 or 2 of the previous article, and the review finds it complies with the law, the central health authority issues the drug license.

符合條件的學名藥藥品許可證申請案，經審查合格且新藥已登載所有專利權消滅後，由中央衛生主管機關核發藥品許可證。

學名藥許可證申請涉及特定聲明時，申請人須在通知送達後20日內書面通知新藥許可證所有人及中央衛生主管機關，並說明主張專利應撤銷或未侵權的理由與證據。

專利權人或專屬被授權人收到通知後，若要就已登載專利提起侵權訴訟，須在45日內提起並通知中央衛生主管機關；主管機關原則上應在新藥許可證所有人收到通知後12個月內暫停核發藥品許可證。

同一申請人、同一藥品的學名藥許可證申請案，中央衛生主管機關依前條第二項暫停核發許可證的次數以一次為限。

在暫停核發藥品許可證期間，中央衛生主管機關完成審查後應通知學名藥許可證申請人；申請人收到通知後可向健保署申請藥品收載及支付價格核價，但在許可證核發前不得製造或輸入。

最先備齊申請資料的學名藥許可證申請案，取得12個月銷售專屬期間；期間未屆滿前，中央衛生主管機關不得核發其他學名藥許可證。

學名藥藥品許可證所有人須在領證後 6 個月內銷售，並在最早銷售日次日起 20 日內檢附實際銷售日證明，報請中央衛生主管機關核定銷售專屬期間及其起迄日期。

如果在銷售專屬期間的學名藥許可證申請人發生指定情形，中央衛生主管機關可以核發該學名藥許可證給其他申請人，且不受第48條之16第1項限制。

涉及藥品專屬期間規定的和解或其他協議，雙方當事人須在事實發生後20日內通報中央衛生主管機關；若屬逆向給付利益協議，還要另行通報公平交易委員會。

中央衛生主管機關可以專案核准特定藥品的製造或輸入，也可以在符合條件時撤銷核准並要求申請者限期處理或回收未使用藥品。

部分新藥需準用學名藥許可證申請規定；符合特定條件的學名藥申請案，則不適用暫停核發藥證與銷售專屬期間規定。

新藥藥品許可證所有人可在修正條文施行後三個月內，依規定提報專利資訊。

中央衛生主管機關可以訂定辦法，規範藥品專利資訊提報、變更或刪除、登載公開、學名藥申請人聲明與書面通知、審查完成通知，以及銷售專屬期間起算與終止等事項。

新藥藥品許可證所有人如有必要提報藥品專利資訊，應在領證次日起45日內，附文件資料向中央衛生主管機關提出。

This provision lists the patent information that must be reported, including patent details, holder details, any exclusive license details, an agent if needed, and consent for a new drug permit holder when different from the patent owner.

新藥藥品許可證所有人若屬特定藥品專利權範圍，須在審定公告次日起45日內提報專利資訊；逾期提報者，不適用本章規定。

新藥藥品許可證所有人須在特定情況發生後 45 日內，對已登載的專利資訊辦理變更或刪除。

Anyone may notify the central health authority in writing with reasons and evidence when one of the listed situations applies. The authority must forward the notice to the new drug permit holder within 20 days, and the permit holder must respond in writing within 45 days; it may also change or delete the patent information if appropriate.

中央衛生主管機關應建立西藥專利連結登載系統，並公開新藥藥品許可證所有人提報的專利資訊；資訊變更或刪除時也同樣辦理。

學名藥藥品許可證申請人申請藥品許可證時，應向中央衛生主管機關聲明與已核准新藥所登載專利權有關的特定情況。

藥商不得買賣來源不明或無藥商許可執照者的藥品或醫療器材。

“試驗用藥物”是指醫療效能及安全尚未經證實，且僅供動物毒性藥理評估或臨床試驗使用的藥物。

藥商不得在沒有醫師處方的情況下調劑供應須由醫師處方的藥品，但法條列出的三種情形除外。

西藥販賣業者不得兼售中藥；中藥販賣業者不得兼售西藥，但成藥不在此限。

藥品販賣業者不得兼售農藥、動物用藥品或其他毒性化學物質。

藥品販賣業者可以把輸入的藥品分裝後出售，但分裝要依規定辦理。

經營西藥批發、輸入或輸出的業者，須符合西藥優良運銷準則，通過中央衛生主管機關檢查，並取得西藥運銷許可後，才能從事相關業務。

藥品或醫療器材在取得藥物輸入許可證後，中央衛生主管機關得為維護國家權益加以管制；但在管制前已核准結匯簽證者，不在此限。

中央衛生主管機關得訂定藥物樣品或贈品的管理辦法；文中另規定已核准製造或輸入的藥物樣品或贈品不得出售。

已核准製售且要出口的藥物，如輸入國要求證明文字，製造廠商必須在輸出前向中央衛生主管機關申請輸出證明書。

藥物原則上只能由藥物製造工廠製造，工廠並須依設廠標準設立、辦理工廠登記，且藥物製造要符合優良製造準則並先取得製造許可。

從事藥物研發的機構或公司，研發用藥物應在符合中央衛生主管機關規定的工廠或場所製造；未經核准，該工廠或場所不得兼製其他產品，研發用藥物也不得用於人體。

藥物工廠未經中央衛生主管機關核准，不得委託他廠製造或接受委託製造藥物。

Western medicine sellers and manufacturers must keep detailed books for controlled and poisonous drugs, store controlled drugs in a locked cabinet, and label controlled and poisonous drugs with warnings and warning signs or colors.

This provision defines what counts as a “drug” under the law.

特定公告類別的藥品，其販賣業者或製造業者須建立藥品來源及流向的追溯或追蹤系統，並以電子方式申報。

管制藥品及毒劇藥品須有醫師處方，才能調劑或供應；管制藥品的領受資料也要登記保存，中央衛生主管機關並可限制其處方與調劑。

中藥販賣業者及中藥製造業者未經中央衛生主管機關核准，不得售賣或使用管制藥品；售賣毒劇性中藥時，沒有中醫師簽名蓋章的處方箋，不得出售。

Non-pharmaceutical merchants may not advertise medicines.

藥商刊播藥物廣告前，先要向衛生主管機關申請核准並把核准文件送給傳播業者；傳播業者不得播未核准、與核准不符、已廢止或尚未改善的藥物廣告。

經中央或直轄市衛生主管機關核准的藥物廣告，有效期間為一年；期滿仍要繼續廣告的，可以向原核准機關申請展延，每次不得超過一年。

Drug advertisements for prescription drugs or drugs designated by the central health authority may only be placed in academic medical publications.

Drug advertisements must not use another person’s name, use publications to guarantee effectiveness or performance, advertise through interviews or reports, or use other improper methods.

Not-equal-to-this-Act drugs must not be labeled or advertised as having medical efficacy.

A drug is treated as a “new drug” if the central competent health authority reviews and recognizes it as a new ingredient, a new efficacy combination, or a new route-of-administration formulation.

採訪、報導或宣傳如果內容暗示或影射醫療效能，就視為藥物廣告。

衛生主管機關可以派員檢查藥物製造業者和販賣業者的場所、設備與相關業務，並可出具單據抽驗藥物；業者不得無故拒絕。

Imported drugs may be brought in only after they are sampled and tested as required by the central health authority.

衛生主管機關可以派員檢查醫療機構或藥局的相關業務，並可憑單抽驗藥物；受檢者不得無故拒絕。

地方衛生主管機關每年要定期普查藥商及藥局；藥商和藥局不得拒絕、規避或妨礙這項普查。

Certain biologically manufactured serums, antitoxins, vaccines, toxoids, and culture fluids may not be sold unless each batch is sampled and inspected by the central health authority and sealed as qualified. The raw material for those biological drugs may only be imported by biological drug manufacturers.

藥物的標籤、仿單或包裝，原則上要依核准內容刊載指定事項；特定藥物還要提供點字或其他可讀性輔助措施。

If a licensed manufactured or imported drug is found to pose a serious danger, the central health authority must immediately prohibit its manufacture and import, revoke its drug permit, and require existing products to stop specified circulation activities; it may also confiscate and destroy them if needed.

地方衛生主管機關對涉嫌的偽藥、劣藥、禁藥或不良醫療器材，可以先封存、抽樣檢驗後再處理；其中偽藥、禁藥屬應先行封存並檢驗。若對衛生有重大危害，還要先報請中央衛生主管機關核准後，才能沒入銷燬。

查獲偽藥、劣藥、禁藥或不良醫療器材時，除依本法其他規定處理外，主管機關可公告業者資訊，情節重大或再犯時還可停止營業或廢止相關許可。

查獲的偽藥、禁藥要沒入銷燬；查獲的劣藥或不良醫療器材，依其是否可改製、是否屬核准輸入，由衛生主管機關監督改製、命令退運出口、封存，或沒入銷燬。

This provision defines “製劑” and gives the central health authority power to set rules for certain medicine classifications, review, sale applications, and sale management.

Certain drug manufacturers or importers must notify medical institutions, pharmacies, and drug sellers, then recall the sold products and handle them with inventory under the law.

Reporting or seizing fake, substandard, prohibited drugs, or defective medical devices should be rewarded.

製造或輸入偽藥或禁藥的人，會被處罰；若造成死亡、重傷、過失犯或未遂，也各有不同刑罰。

明知是偽藥或禁藥而販賣、供應、調劑、運送、寄藏、牙保、轉讓，或為販賣而陳列的，會受刑罰；過失犯、致死、致重傷及未遂也有不同處罰。

未經核准製造或輸入醫療器材，或明知其為該等器材而販賣等行為，會受到刑罰；過失犯前項之罪也有較輕處罰。

This provision punishes making or importing certain bad drugs or unsuitable medical devices, and also punishes negligent or knowing sale, supply, transport, storage, transfer, or display for sale of those goods.

冒用他人藥物名稱、仿單或標籤，或明知是前項藥物而進口、販賣、供應等，會有刑責與罰金。

法人代表、代理人、受雇人或其他從業人員因執行業務犯第82條至第86條之罪時，除處罰行為人外，法人或自然人也會被科以各該條十倍以下的罰金。

查獲用於製造或調劑偽藥、禁藥的器材要沒收，不論是否屬於犯罪行為人；犯罪所得及追徵範圍、價額難以認定時，可以用估算方式認定，估算辦法由中央衛生主管機關定。

公務員如果假借職務上的權力、機會或方法，犯本章各條的罪，或包庇他人犯本章各條的罪，依各該條規定可加重其刑至二分之一。

This provision defines “成藥” (patent medicine) as a processed raw drug that meets listed conditions, including limited additive content, mild action, no accumulation, long storage, ease of use, stated effects/dosage/instructions, a patent medicine permit number, and use without a doctor’s instruction.

This provision imposes fines for manufacturing or importing specified substandard drugs or defective medical devices, and for selling or handling them in listed ways.

違反第六十五條、或第八十條第一項第一款至第四款之一、或第六十九條者，會被處以罰鍰；違反第六十九條者，其違法物品還會被沒入銷燬。

This article sets fines for multiple drug-law violations and gives the central health authority powers to publish names, order improvements, suspend operations, block permit extensions, refuse new applications, and revoke certain permits.

新藥藥品許可證所有人若經中央衛生主管機關通知限期回覆而逾期未回覆，會被處罰鍰；未依通報方式及內容規定通報，也會被處罰鍰。

違反列舉的條文或相關辦法者，可能被處新臺幣3萬元以上500萬元以下罰鍰；對違反第16條第2項或第30條者，衛生主管機關還可以停止其營業。

If a person violates one of the cited provisions, a fine of NT$20,000 to NT$100,000 applies.

傳播業者違反第六十六條第三項或第四項時，會被處以罰鍰；第三項違規且經主管機關通知限期停止後仍繼續刊播的，罰鍰更高，並會按次連續處罰直到停止刊播。

違規藥物廣告除既有處罰外，衛生主管機關可公告負責人與違規內容；情節重大時可廢止許可證，並可要求業者限期刊登致歉聲明。

藥商違反特定申報、通報、限制措施或其他規定時，可能被公告資料、限期改善，並處罰鍰；逾期未改善者還可加重或按次處罰。

藥商以不實資料或證件辦理藥物許可證的查驗、展延或變更登記時，除可撤銷該許可證外，二年內不得再申請該許可證的查驗登記；若涉及刑事責任，還會移送司法機關處理。

若送驗藥物與申請資料不符，中央衛生主管機關在一定期間內不得受理該製造廠其他藥物的新申請；若申復後重新檢驗仍未通過，禁止期間改為一年。

受罰人不服罰鍰時，可在送達後15日內書面提出異議申請復核，且只能一次；主管機關收到後應在15日內重行審核，認為有理由時應變更或撤銷原處罰，之後還可依法提起訴願及行政訴訟。

藥物查驗登記、許可證變更、移轉或展延案件未核准時，申請人可在送達處分書後四個月內提申復，且以一次為限。
