健康食品管理法

This provision states that the law is enacted to strengthen the management and supervision of health foods, protect public health, and safeguard consumer rights, and that matters not covered by this law follow other related laws.

Health food manufacturers must comply with good manufacturing practice, and imported health food must comply with the producing country’s good manufacturing practice standards.

健康食品及其容器、包裝必須符合衛生要求；其標準由中央主管機關訂定。

Certain health foods or their ingredients must not be manufactured, mixed, processed, sold, stored, imported, exported, gifted, or publicly displayed if they are spoiled, contaminated, adulterated, counterfeit, past the storage期限, or otherwise harmful to health.

健康食品的標示內容與方式須符合本條要求；輸入者還要註明國內負責廠商名稱與地址。

健康食品的標示或廣告不得虛偽、誇張，也不得宣稱醫療效能；其保健效能宣稱不能超過許可範圍，並要符合中央主管機關查驗登記的內容。

傳播業者不得替未取得第七條許可證的食品刊播健康食品廣告；接受委託刊播的健康食品傳播業者，還要在廣告日起六個月內保存委託者資料，並在主管機關要求時不得規避、妨礙或拒絕提供。

衛生主管機關可以派員檢查健康食品業者的場所、設備和相關業務，也可以抽驗健康食品；業者不得無故拒絕。

如果經許可製造或輸入的健康食品被發現有重大危害，中央主管機關應公告禁止其製造、輸入，並廢止許可證。

If certain health-food problems arise, the manufacturer or importer must notify downstream businesses and recall the products for sale within the required time. Downstream businesses must cooperate with the recall.

當地主管機關得依抽查、檢驗結果，對健康食品作成沒入銷毀、通知限期改正、撤銷原處分並啟封等處分；相關業者名稱、地址等也可能被公告。

This provision defines “health food” and “health efficacy.”

主管機關應對舉發或緝獲不符本法規定的健康食品者予以獎勵，並可另行訂定獎勵辦法。

未经核准制造或输入健康食品，或明知为前项食品而销售、供应、运输、寄藏、转让、标示、广告或陈列出售的，都会受到处罚。

If a person violates Article 12, they face a fine; repeat violations within one year bring a higher fine and may also lead to revocation of the business or factory registration certificate.

Anyone who violates the specified provisions may be fined, with higher fines and possible license revocation if the violation is repeated within a year; if the conduct harms human health, criminal penalties may also apply.

違反相關健康食品或廣告規定時，主管機關或地方政府可裁罰罰鍰，並可要求停止刊播；情節重大或一年內再犯時，還可能被廢止許可證或登記證照。

Violating Article 18 can result in a fine of NT$300,000 to NT$1,000,000, and the fine may be imposed continuously on a daily basis.

If a representative, agent, or employee commits an offense under Articles 21–22 while performing business duties, the actor is punished under those articles and the juridical person or natural person is also fined under the same articles.

不得拒絕、妨害或故意逃避第十六條、第十七條的抽查、抽驗，也不得違反命令停止或禁止製造、調配、加工、販賣、陳列；違反者可被罰鍰，情節重大或一年內再犯時還可能被廢止登記證照。

Except for Article 24(4), the municipal or county (city) competent authority imposes the fines provided by this Act.

If the seller violates specified provisions, the buyer may return the goods and seek a refund; if the seller knew, the seller must refund double. If the buyer has other losses, the court may order punitive damages at the victim’s request, up to three times retail price or damage amount. Manufacturers, importers, and sellers may share joint liability when they know or are jointly negligent with the seller.

符合條件的健康食品，中央主管機關應核發健康食品許可證。

中央主管機關有權訂定本法施行細則。

本法一般在公布後六個月施行；修正條文則自公布日施行。

健康食品的保健功效應以列出的四種方式之一表達。

This provision defines the competent authority: the Ministry of Health and Welfare at the central level, the municipal government in a special municipality, and the county/city government in a county or city.

食品不得在未依本法規定時標示或廣告為健康食品；涉及特殊營養素或特定保健功效的食品標示或廣告，應依本法辦理。

Manufacturers and importers of health food must apply for inspection registration, submit required materials and pay the fees before they may manufacture or import.

Health food manufacturing/import permits last five years; renewal must be applied for within three months before expiry, and damaged or lost permits must be replaced or reissued.

中央主管機關可在健康食品許可證有效期間內，因特定疑義或質疑事由重新評估；若評估不合格，應通知相關廠商限期改善，逾期未改善時得廢止許可證。
