人類免疫缺乏病毒傳染防治及感染者權益保障條例

This provision states the purpose of the statute: to prevent HIV infection and transmission, protect national health, and safeguard the rights of infected persons.

旅館業及浴室業的營業場所，應提供保險套及水性潤滑劑。

在輸血、製造血液製劑，以及器官、組織、體液或細胞移植前，原則上要先做與 HIV 有關的檢驗；檢驗陽性時，醫事機構要通報主管機關。

感染者必須提供感染源或接觸者資訊，並在就醫時告知醫事人員自己已感染人類免疫缺乏病毒；主管機關可調查，但不得侵害人格與隱私，醫事機構與醫事人員也不得拒絕提供服務。

醫事人員發現感染者後，應在二十四小時內向地方主管機關通報。

相關機關、醫事機構、醫事人員及因業務知悉資料的人，原則上不得洩漏感染者的姓名、病歷等資料；只有依法或基於防治需要時例外。

主管機關應通知特定人到指定醫事機構接受 HIV 諮詢與檢查；相關費用由中央主管機關及中央各目的事業主管機關編列；醫事人員在抽血檢查前原則上要先取得當事人同意並完成諮詢程序。

醫事人員在醫療必要或急迫時，得依特定情形採集檢體做 HIV 檢測，部分情況下不需受檢查人或法定代理人同意。

感染者應到中央主管機關指定的醫療機構接受治療與定期檢查、檢驗；拒絕者，地方主管機關得施予講習或輔導教育。

醫事人員發現感染者屍體後，應在一週內向地方主管機關通報；地方主管機關接獲通報後，應立即指定醫療機構依防疫需要與家屬意見作適當處理。

This provision defines which authority counts as the competent authority at each government level.

This article is marked deleted and contains no operative rule.

If a person who knows they are infected hides that fact and engages in risky conduct or shared-injection conduct that infects another person, or donates blood/organs/tissues/body fluids/cells for transplant or use and infects another person, they face imprisonment of 5 to 12 years.

Violating the specified Article 11 provisions can result in a New Taiwan dollar fine, and if it causes HIV infection, imprisonment applies.

This provision sets fines for several violations, allows the主管機關 to require correction within a time limit, and sends seriously offending medical personnel to the central competent authority for discipline.

違反第十條規定且經限期改善後仍未改善的，由營業場所負責人受新臺幣三萬元以上十五萬元以下罰鍰；違反第八條第一項而不接受講習的，處新臺幣一萬元以上五萬元以下罰鍰。

本條規定，罰鍰原則上由直轄市或縣（市）主管機關處罰；第二十三條的罰鍰也可以由中央主管機關處罰。

中央主管機關應獎勵對感染者服務或執行本條例相關工作有績效者；服務機關（構）應給予因執行相關工作而感染 HIV 者合理補償。

This provision says the law takes effect on the date it is promulgated, while the amendments to Article 16, paragraphs 3 and 4, take effect two years after promulgation.

This provision defines who counts as a “person infected with HIV.”

感染者的人格與合法權益應受尊重並受保障；中央主管機關可就其工作訂定必要的執業執行規範，並應會商相關主管機關訂定權益保障辦法。

中央主管機關 must invite specified groups and government representatives to participate in HIV prevention and infected persons’ rights work, with seat-share limits for single gender and for certain stakeholder groups.

醫事機構 must follow the competent authority’s rules to carry out HIV screening and prevention work; the competent authority funds the cost through its budget.

主管機關應辦理 HIV 防治教育及宣導；中央各目的事業主管機關應訂定年度教育及宣導計畫，內容要有性別意識並著重反歧視宣導。

符合列舉情形的人，必須接受愛滋病及其他性病防治講習；講習的課程、時數、執行單位及其他事項由中央主管機關訂定。

主管機關得視需要建立針具提供、交換、回收及成癮替代治療機制；中央主管機關並訂定相關辦法。參與該機制而提供或持有針具或管制藥品者，不負刑事責任。
