優生保健法

This law is enacted to implement eugenic health care, improve population quality, protect mother-and-child health, and promote family happiness.

已婚或符合例外情形的人，可以依自願施行結紮手術；某些未婚未成年人、受監護或輔助宣告的人，需取得法定代理人或輔助人同意；中央主管機關必要時得訂定並公告認定標準。

醫師發現特定疾病或胎兒異常時，應告知相關人，並在特定情況下勸導接受治療、結紮或人工流產。

不是第五條所定醫師而施行人工流產或結紮手術者，會被罰鍰。

未取得合法醫師資格的人，不得擅自施行人工流產或結紮手術；違反者依醫師法第28條處罰。

經催告後仍逾期未繳納的本法罰鍰，由主管機關移送法院強制執行。

政府可以對依第六、七、九、十條接受優生保健措施的人減免或補助費用；相關辦法由中央主管機關擬訂，報行政院核定後施行。

中央主管機關負責訂定本法施行細則。
