癌症防治法

This law is enacted to coordinate medical and health resources and promote cancer prevention, reduce the threat of cancer, and protect national health.

財團法人國家衛生研究院應設癌症研究中心，並辦理及整合癌症相關研究、治療方法、診斷技術、治療藥品開發與臨床試驗。

癌症防治醫療機構 must 向受中央主管機關委託的學術研究機構提報癌症防治相關資料。

受理第十一條資料提報的機構，必須指定專人依相關法令辦理安全維護，並防止個人資料被竊取、竄改、毀損或滅失。

主管機關得視需要辦理人民癌症預防與篩檢，相關經費可由菸品健康福利捐分配收入支應，或接受機構、團體捐助。

癌症篩檢醫療機構應主動催促其篩檢出的癌前期及癌症陽性個案回院確診，或提供轉診資訊。

癌症防治醫療機構 must 在內部成立癌症醫療品質小組，以確保癌症篩檢及診斷治療品質。

國家應投入足夠人力與經費，以有效推動癌症防治工作。

違反第十一條第一項限期提報而逾期未提報，或違反第十二條規定者，會被處以罰鍰；罰鍰由中央主管機關處罰。

This law takes effect on the date it is promulgated.

This provision defines the competent authority: the Ministry of Health and Welfare at the central level, municipal governments in special municipalities, and county/city governments in counties or cities.

This article defines “cancer” and “cancer screening.”

This provision defines cancer prevention and control to include education, screening, patient-centered care, palliative care for terminal patients, research, databases, training, and other related prevention, diagnosis, treatment, and care matters.

國家應提供資源、整合公私部門，推動癌症防治、臨床試驗、醫學技術研發，並把防癌與癌症病人就醫的正確知識納入國民義務教育，同時致力降低國民接觸可能致癌因子。

行政院為執行癌症防治政策，應設中央癌症防治會報；該會報由行政院院長兼任召集人，並且每年至少開會一次。

中央主管機關應設立癌症防治政策委員會；委員會執行任務時，應徵詢相關專家、產業、癌症病人及家屬代表的意見。

癌症防治政策委員會由衛生福利部部長擔任召集人，委員人數為十八至二十四人，並須符合成員組成、性別比例與會議召開頻率等要求。

中央主管機關可以整合癌症篩檢與診療機構並補助相關設置；癌症防治中心則必須依委員會決議辦理癌症宣導、篩檢、診療、後續計畫、安寧照護整合、資料庫、轉介網路、訓練與品質保證等事項。
