長期照顧服務法

中央主管機關 must regularly survey long-term care resources and needs, consider multicultural and remote-island/rural conditions, and use that to set development plans and subsidies.

長照機構在停業、歇業、復業或許可證明登載事項變更時，應在事實發生前30日內報主管機關核定。停業最長1年，必要時可申請延長1次、再1年；逾期應辦理歇業，未辦理者主管機關得廢止設立許可。

長照機構名稱的冠稱和場所標示有強制要求：政府機關（構）設立的，要在機構名前加上該機關（構）名稱；民間設立的，要加上「私立」。

非長照機構不得使用長照機構之名稱。

長照機構不得使用某些名稱，包括與同一縣市內已廢止許可或已許可設立的機構相同的名稱，以及容易使人誤認與政府機關或其他公益團體有關的名稱。

非長照機構不得為長照服務做廣告；長照機構刊登或播放廣告時，內容只能限於法條列出的事項。

中央主管機關要輔導地方主管機關提供長照機構收費參考資訊；長照機構的收費項目及金額要報所在地主管機關核定，變更時也一樣。

長照機構收費時，應開立載明收費項目及金額的收據；也不得違反前條收費規定、超額收費或擅自新增收費項目。

長照機構必須在機構內明顯處所揭示設立許可證明、收費、服務項目及主管機關所設的陳情管道資訊。

長照機構應督導所屬登錄的長照人員，就長照服務相關事項製作紀錄；其中醫事照護部分，原則上由機構至少保存7年，但若依醫事法令保存者，適用該規定。

主管機關要對長照機構進行輔導、監督、考核、檢查與評鑑；必要時可通知其提供相關服務資料，長照機構不得規避、妨礙或拒絕，且中央主管機關可訂定評鑑辦法。

主管機關可進入未經許可設立而提供長照服務的場所檢查；受檢查者不得規避、妨礙或拒絕，並要提供必要文件、資料或協助。

中央主管機關負責長照相關事項的規劃、監督、協調、推動與管理。

主管機關應依所列原則訂定長照服務品質基準。

長照機構歇業或停業時，須先為服務使用者安排適當轉介或安置；做不到時，主管機關會協助，機構也要配合。

長照機構在提供長照服務時，必須與使用者、家屬或付款者簽書面契約。

未經書面同意，不得為長照服務使用者錄影、錄音、攝影，或報導、記載其可辨識身分的資訊；長照機構為維護安全而設置監看設備時，須先告知相關人員。

長照機構及其人員必須適當照顧並保護長照服務使用者，不得遺棄、虐待、歧視、傷害或違法限制其人身自由。

主管機關應建立陳情、申訴及調處機制，並處理民眾申訴案件及長照服務單位委託的爭議事件。

地方主管機關要在特定情況下監督住宿式長照服務品質，長照機構不得拒絕配合。

長照機構有特定違規情形時，主管機關可處新臺幣6萬元以上30萬元以下罰鍰，並公布機構名稱及負責人姓名。

未經許可設立的長照機構，只要提供服務、妨礙查核、未配合轉介安置，或對服務對象有棄置、虐待、歧視、傷害、違法限制自由等情形，負責人會被罰鍰並公布姓名；情節更嚴重或導致死亡時，罰鍰更高。

If a long-term care institution violates the standards for permit establishment, it must be ordered to correct the issue within a deadline.

長照特約單位違反第32-2條規定時，會依相關法律處罰；受處罰後仍未改善的，可能被停止派案，情節重大時還可能被終止特約。

長照特約單位或長照機構違反指定條文時，會被處新臺幣三萬元以上十五萬元以下罰鍰，並被限期追收或退還相關費用。

地方主管機關負責掌理長照服務相關事項。

This provision fines certain persons or institutions TWD 10,000 to 50,000 for three listed violations related to long-term care services and use of the long-term care institution name.

Long-term care institutions, and also non-long-term-care institutions advertising long-term care services, can be fined if they breach the listed advertising rules.

長照機構提供長照服務時，如未依第42條簽書面契約，或契約內容違反中央主管機關規定，主管機關應限期命其改善；屆期未改善者，將處新臺幣1萬元以上5萬元以下罰鍰，且可按次處罰。

長照機構違反本條列出的管理、報核、契約、紀錄或配合評鑑義務時，可能被罰鍰、限期改善，情節或未改善時還可能停業；評鑑不合格時也有更重處分。

Violations by specified long-term care actors can lead to a NT$6,000–30,000 fine, an order to correct the violation, and, if not corrected and serious, a business suspension of 1 month to 1 year.

If a long-term care institution violates Article 36(1) or Article 37, it must be ordered to correct the violation within a deadline; if it fails to do so, it faces a fine of NT$6,000 to NT$30,000.

Long-term care personnel who make false records, lend their certificate to others, or violate Article 44 may be fined NT$6,000 to NT$30,000; they may also be suspended for 1 month to 1 year, and serious cases may have their certificate revoked.

長照機構若僱用未接受第六十四條第一項訓練的個人看護者，會被處以罰鍰。

If listed long-term care personnel rules are not met, a fine of NT$3,000 to NT$15,000 applies.

長照機構在特定重大違規情形下，可能被廢止設立許可；相關情節認定時，主管機關要調查並給予陳述意見機會。

本法的罰則由地方主管機關處罰。

原本已依法提供長照服務的人員，在本法施行後二年內可以繼續提供服務，且不受第十八條第一項限制；相關訓練課程的整合、證明轉銜與認定標準由中央主管機關訂定。

本法施行前已依法提供長照服務的機關、法人、團體、合作社、事務所等，可以依原適用法令繼續提供服務；但實際執行長照服務人員的認證、繼續教育、登錄及處罰，改適用本法。

這些附設長照機構原則上依本法辦理，但在特定條文的許可、核定程序上不適用；並且在上級主管機關核准後30日內，須向所在地主管機關報備。

個人看護者應接受中央主管機關公告指定的訓練；符合條件的雇主可以為特定外國人申請補充訓練。

中央主管機關負責訂定本法施行細則。

This Act starts two years after it is promulgated, except that certain amended provisions take effect on promulgation date and one specified set takes effect on 3 June 2017.
