違反糧食管理治罪條例

Violations of food management are punished under this ordinance; any matter not covered by the ordinance follows other laws.

公務人員若利用職務上的權力、機會或方法，為自己或他人違反糧食管理法令，將依本條例從重處罰。

公務人員或軍警不得不依法令擅自封閉民倉；違反者，處五年以上十年以下有期徒刑。

公務人員或軍警在管理或徵購糧食時，不得藉機勒索或以其他方式營私舞弊；違者依戡亂時期貪污治罪條例治罪。

Anyone may report violations of this rule to the food authorities, and the authority must keep the reporter’s name secret.

罰金或沒收糧食折價後，依法定比例在執行終結後發給獎金；剩餘款項由糧食主管機關專案解交國庫。

依本條例治罪的案件，原則上送法院審理；被告是現役軍人時，改由有軍法審判權的機關審判。沒收、罰金及相關執行事項，部分由原審判機關移送當地糧食主管機關處理，必要時再送當地法院辦理。

本條例的施行區域由行政院以命令指定。

This provision says the statute takes effect on the date it is promulgated.

This provision defines “food/grain” and says provincial or municipal governments must get approval from the central grain authority before announcing management measures for miscellaneous grains.

Certain specified food-handling or selling conduct is treated as hoarding/speculation.

囤積居奇者按囤積的穀物數量分級受罰，並可沒收全部糧食；第六款情節輕微者可免刑。

民戶和公私機關團體購存自食糧都有數量上限；超過需要量時，須報請當地糧食主管機關核准，未核准的超過部分會被沒收。

違反糧食主管機關公告禁止的特定糧食交易行為，可能會受刑罰、罰金，且相關契約無效；某些金融、農業或行政機關辦理特定糧食相關業務前，須先報請糧食主管機關核准。

違反糧食主管機關就地域、期限、數量、價格或程序的規定而買賣或運輸糧食或指定加工品者，會被處以罰金。

If a person does not follow one of the listed food-authority rules, they may be fined up to 500 yuan and their food may be confiscated.

Certain grain business operators, and business operators/farmers with stored grain, can be fined up to 20% of the grain price if they do not keep detailed books, file required reports, or report/register stored grain with the grain authority.
